DESCRIPTION:
Expands the breadth of Diamond Head State Monument area to
include all public lands within the area bounded in the north by
the Diamond Head Crater ridgeline, in the south by the shoreline,
in the west by Diamond Head Park, and in the east by Kuilei

                   A  BILL  FOR  AN  ACT

RELATING TO DIAMOND HEAD.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that in 1992, by adopting
 
 2 Act 313, it reaffirmed the recognition of Diamond Head Crater as
 
 3 a natural landmark by the federal government and a state monument
 
 4 by the State of Hawaii.  Act 313 included additional lands within
 
 5 the Diamond Head State Monument area and required conformance to
 
 6 the Diamond Head State Monument Plan of 1979 which outlined a
 
 7 state policy of establishing a semi-wilderness park in Diamond
 
 8 Head Crater.
 
 9      The purpose of this Act is to expand the size of the Diamond
 
10 Head State Monument area to include all public lands within the
 
11 area bounded in the north by the Diamond Head Crater ridgeline,
 
12 in the south by the shoreline, in the west by Diamond Head Park,
 
13 and in the east by Kuilei Cliffs Beach Park.
 
14      SECTION 2.  Section 6E-32, Hawaii Revised Statutes, is
 
15 amended by amending subsection (a) to read as follows:
 
16      "(a)  There shall be a Diamond Head State Monument as a
 
17 historical site on Oahu to be administered by the department of
 
18 land and natural resources, and to consist of all public lands
 
19 within the area bounded in the north by the Diamond Head Crater

 1 ridgeline, in the south by the shoreline, in the west by Diamond
 
 2 Head Park, and in the east by Kuilei Cliffs Beach Park and those
 
 3 lands that the department considers essential to the unimpaired
 
 4 preservation of the visual and historic aspects of Diamond Head
 
 5 and those state lands more fully described in this section that
 
 6 may be best used for recreational purposes and to increase public
 
 7 access and enjoyment of the monument."
 
 8      SECTION 3.  New statutory material is underscored.
 
 9      SECTION 4.  This Act shall take effect upon its approval.
