                   A  BILL  FOR  AN  ACT

RELATING TO WELFARE. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 346-1, Hawaii Revised Statutes, is
 
 2 amended by amending the definition of "minor dependents" to read: 
 
 3      ""Minor dependents" means dependents living in the home of a
 
 4 specified adult, as defined by rules, in which the adult is the
 
 5 primary caretaker and the dependent is under eighteen [or if
 
 6 between eighteen and nineteen, enrolled full-time in a program of
 
 7 secondary or equivalent level vocational or technical school, and
 
 8 is expected to complete the program before reaching age
 
 9 nineteen]."
 
10      SECTION 2.  Section 346-71. Hawaii Revised Statutes, is
 
11 amended by amending subsection (a) to read as follows:
 
12      "(a)  The department of human services is authorized to
 
13 administer and provide public assistance to eligible persons who
 
14 are disabled, who are not otherwise provided for under this
 
15 chapter, and who are unable to provide sufficient support for
 
16 themselves or those dependent upon them; provided that such
 
17 persons:
 
18      (1)  Have first been determined ineligible for a comparable
 
19           federally funded financial assistance program;

 1      (2)  Are bona fide residents of this State; and
 
 2      (3)  Have furnished to the department a social security
 
 3           account number for each member of the assistance unit
 
 4           or verification that an application was made with the
 
 5           Social Security Administration for a social security
 
 6           account number for each member of the assistance unit.
 
 7      Persons who meet the categorical criteria for eligibility,
 
 8 but fail to satisfy income and resource criteria adopted by the
 
 9 department shall not be eligible for general assistance to
 
10 household without minor dependents.  The failure of any adult
 
11 member of the assistance unit to comply with the requirements or
 
12 conditions of general assistance to households without minor
 
13 dependents shall exclude the entire assistance unit from
 
14 receiving financial assistance.  However, when the adult member
 
15 is disqualified for not meeting the work requirement, the
 
16 assistance unit shall not be disqualified if the assistance unit
 
17 was formed after the failure to meet the work requirement
 
18 occurred.  "Assistance unit" as the term is used in this section
 
19 means persons whose needs, income, and assets are considered in
 
20 the financial assistance payment and their dependents.
 
21      For purposes of determining whether persons seeking
 
22 assistance are bona fide residents of this State, the department
 
23 of human services shall consider, but is not limited to

 1 considering, the following factors:  
 
 2      (1)  Enrollment and receipt of welfare benefits from another
 
 3           jurisdiction;
 
 4      (2)  Physical presence in the State;
 
 5      (3)  Maintenance of a place of residence in the State;
 
 6      (4)  The availability of furnishings and household and
 
 7           personal effects sufficient to lead a reasonable person
 
 8           to conclude that the place of residence is more than a
 
 9           public accommodation;
 
10      (5)  Qualification as to residence for purposes of voting in
 
11           the State;
 
12      (6)  Change in vehicle operation license;
 
13      (7)  Vehicle registration; and
 
14     [(8)  Enrollment of children in local schools; and
 
15      (9)] (8) Bank accounts in this State or any other
 
16           jurisdiction."
 
17      SECTION 3.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 4.  This Act shall take effect upon its approval.
