                   A  BILL  FOR  AN  ACT

RELATING TO LOBBYISTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 97, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§97-    Findings and purpose.  The Legislature finds that
 
 5 appropriations of public funds for the benefit of non-
 
 6 governmental agencies should be expended for public purposes
 
 7 only.  The Legislature further believes that public
 
 8 appropriations should not be used to pay for the salary, fees, or
 
 9 commissions of lobbyists seeking to influence legislation for the
 
10 benefit of a non-governmental agency, even if such appropriations
 
11 are for a public purpose.  The purpose of this act is to
 
12 safeguard the proper use of public funds and maintain public
 
13 confidence by prohibiting payment of state funds to lobbyists.
 
14      "§97-    Use of state funds prohibited.  Notwithstanding any
 
15 law to the contrary, no state moneys may be used to pay the
 
16 salary, fees, or commissions of a lobbyist."
 
17      SECTION 2.  Section 11-203, Hawaii Revised Statutes, is
 
18 amended by amending subsection (e) to read as follows:

 1      "(e)  The following expenses incident to a fundraiser and to
 
 2 all other political fundraising activities held for the benefit
 
 3 of a candidate shall not be considered expenditures within the
 
 4 limitations set by section 11-209:
 
 5      (1)  The cost of food and beverages consumed at the
 
 6           function;
 
 7      (2)  Rent and utilities for the premises where the function
 
 8           is held;
 
 9      (3)  The amount paid for guest speakers and entertainment;
 
10      (4)  Printing and postage related to a function; and
 
11      (5)  All other direct costs incurred in solicitation of the
 
12           fundraiser, or fundraising activity[.];
 
13 provided that no state moneys shall be used to pay the salary,
 
14 fees, or commissions of a lobbyist, as defined in section 97-1,
 
15 in connection with the fundraiser or other political fundraising
 
16 activities."
 
17      SECTION 3.  This Act does not affect rights and duties that
 
18 matured, penalties that were incurred, and proceedings that were
 
19 begun, before its effective date.
 
20      SECTION 4.  Statutory material to be repealed is bracketed.
