                   A  BILL  FOR  AN  ACT

RELATING TO DANGEROUS WEAPONS.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 134-51, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§134-51  Deadly weapons; prohibitions; penalty.(a)  Any
 
 4 person, not authorized by law, who carries concealed upon the
 
 5 person's self or within any vehicle used or occupied by the
 
 6 person or who is found armed with any dirk, dagger, butterfly
 
 7 knife, blackjack, slug shot, billy, metal knuckles, pistol, or
 
 8 other deadly or dangerous weapon shall be guilty of a misdemeanor
 
 9 and may be immediately arrested without warrant by any sheriff,
 
10 police officer, or other officer or person.  Any weapon, above
 
11 enumerated, upon conviction of the one carrying or possessing it
 
12 under this section, shall be summarily destroyed by the chief of
 
13 police or sheriff.
 
14      (b)  Whoever knowingly possesses or intentionally uses or
 
15 threatens to use a deadly or dangerous weapon while engaged in
 
16 the commission of a crime shall be guilty of a class C felony.
 
17      (c)  Whoever knowingly or intentionally sells or transfers
 
18 any deadly weapon to a minor shall be guilty of a class C
 
19 felony."

 1      SECTION 2.  Section 134-52, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§134-52  Switchblade knives; prohibitions; penalty.(a)
 
 4 Whoever knowingly manufactures, sells, transfers, possesses, or
 
 5 transports in the State any switchblade knife, being any knife
 
 6 having a blade [which] that opens automatically:
 
 7      (1)  [by] By hand pressure applied to a button or other
 
 8           device in the handle of the knife[,]; or
 
 9      (2)  [by] By operation of inertia, gravity, or both,
 
10 shall be guilty of a misdemeanor.
 
11      (b)  Whoever knowingly possesses or intentionally uses or
 
12 threatens to use a switchblade knife while engaged in the
 
13 commission of a crime shall be guilty of a class C felony.
 
14      (c)  Whoever knowingly or intentionally sells or transfers a
 
15 switchblade knife to a minor shall be guilty of a class C
 
16 felony."
 
17      SECTION 3.  This Act does not affect rights and duties that
 
18 matured, penalties that were incurred, and proceedings that were
 
19 begun, before its effective date.
 
20      SECTION 4.  Statutory material to be repealed is bracketed.

 1      SECTION 5.  This Act shall take effect upon its approval.
