DESCRIPTION:
Allows the administrator of the narcotics enforcement division to
share information from the electronic prescription accountability
system with "dispensers" (practitioners who dispense controlled

                   A  BILL  FOR  AN  ACT

RELATING TO CONTROLLED SUBSTANCES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 329-104, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  This section shall not prevent the disclosure, at the
 
 4 discretion of the administrator, of investigative information to:
 
 5 law enforcement officers; investigative agents of federal, state,
 
 6 or county law enforcement agencies; prosecuting attorneys; [or]
 
 7 the attorney general[, in furtherance of criminal investigations
 
 8 or prosecutions within their respective jurisdictions;] or
 
 9 dispensers; provided that the administrator has reasonable
 
10 grounds to believe that the disclosure of any information
 
11 collected under this part is in furtherance of an ongoing
 
12 criminal investigation[.] or prosecution."
 
13      SECTION 2.  There is appropriated out of the controlled
 
14 substance registration revolving fund the sum of $50,862, or so
 
15 much thereof as may be necessary for fiscal year 1999-2000, for
 
16 one full-time equivalent (1.00 FTE) data processing systems
 
17 analyst IV position and other current expenses to carry out the
 
18 purpose of this Act.  The sum appropriated shall be expended by
 
19 the department of public safety.

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect on July 1, 1999.
