                   A  BILL  FOR  AN  ACT

RELATING TO SEXUAL OFFENDERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that one in three repeat
 
 2 sexual offenders will re-offend despite treatment.  Re-offenses
 
 3 usually occur three and one-half years after release from prison,
 
 4 primarily because, once parole is completed, monitoring of the
 
 5 sexual offender is insufficient.  According to a National
 
 6 Institute of Justice research report release in June 1997 on
 
 7 child sexual molestation, "[i]ntensive community-based
 
 8 supervision and management of child molesters are essential to
 
 9 reduce sexual victimization rates; child abusers have been known
 
10 to re-offend as late as twenty years following release into the
 
11 community."
 
12      The legislature recognizes that many repeat sexual offenders
 
13 can be viable, contributing members of the community.  However,
 
14 similar to a person with a life-long disease that requires
 
15 medical supervision to the end of life, a repeat sexual offender
 
16 who has a high-risk repeat disorder needs continual supervision
 
17 until the end of life.  With continual supervision and guidance,
 
18 many repeat sexual offenders will not return to the criminal
 
19 justice system, thus providing greater protection to the public

 1 and saving taxpayer's dollars for prison space.
 
 2      The purpose of this Act is to require a mandatory lifetime
 
 3 parole term for second time felony sexual offenders.
 
 4      SECTION 2.  Chapter 706, Hawaii Revised Statutes, is amended
 
 5 by adding a new section to be appropriately designated and to
 
 6 read as follows:
 
 7      "§706-    Repeat sexual offender; lifetime parole.
 
 8 Notwithstanding section 706-669, 706-670, or any other provision
 
 9 of law to the contrary, the Hawaii paroling authority shall
 
10 impose a mandatory lifetime parole term upon any person who is
 
11 convicted under section 707-730, 707-731, 707-732, or 707-733.5,
 
12 after having previously been convicted of an offense under
 
13 section 707-730, 707-731, 707-732, or 707-733.5 or of an offense
 
14 under federal law or the laws of another state that is comparable
 
15 to an offense under section 707-730, 707-731, 707-732, or
 
16 707-733.5.  Under no circumstances shall the Hawaii paroling
 
17 authority finally and unconditionally release such person."
 
18      SECTION 3.  This Act shall apply to any person convicted of
 
19 any offense under section 707-730, 707-731, 707-732, or 707-733.5
 
20 after the effective date of this Act.
 
21      SECTION 4.  New statutory material is underscored.
 
22      SECTION 5.  This Act shall take effect upon its approval.
