                   A  BILL  FOR  AN  ACT

RELATING TO BUDGETING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 37, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§37-     Conformance to legislative priorities.  If revenue
 
 5 shortfalls cause modification or reduction of allotments under
 
 6 section 37-35 or 37-36, reductions in allotments shall so far as
 
 7 practical be made in equal percentages across affected
 
 8 appropriations; provided that equality of reduction shall not be
 
 9 required where it would create an illegal result.  If thereafter
 
10 revenue is greater than assumed at the time of the modification
 
11 or reduction, the governor or director of finance shall promptly
 
12 restore allotments in proportion to any reductions made and
 
13 consistent with actual revenue, so that allotments so far as is
 
14 practical shall be proportionate to the legislature's
 
15 appropriations.  The governor and the director of finance shall
 
16 not reduce allotments based on targeted or anticipated savings,
 
17 changing conditions, changes in law, or efficiency increases,
 
18 unless appropriated moneys freed thereby cannot be used for the
 
19 programmatic purposes of the appropriation."
