                   A  BILL  FOR  AN  ACT

PROPOSING AN AMENDMENT TO ARTICLE X, SECTION 6, OF THE HAWAII
   CONSTITUTION, TO PROVIDE THE UNIVERSITY OF HAWAII WITH
   AUTONOMY IN ALL MATTERS RELATED TO THE UNIVERSITY.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to propose an
 
 2 amendment to article X, section 6, of the Constitution of the
 
 3 State of Hawaii to give the University of Hawaii autonomy in
 
 4 matters involving only the internal structure, management, and
 
 5 operation of the University.
 
 6      SECTION 2.  Article X, section 6, of the Constitution of the
 
 7 State of Hawaii is amended to read as follows:
 
 8                     "BOARD OF REGENTS; POWERS
 
 9      Section 6.  There shall be a board of regents of the
 
10 University of Hawaii, the members of which shall be nominated
 
11 and, by and with the advice and consent of the senate, appointed
 
12 by the governor.  At least part of the membership of the board
 
13 shall represent geographic subdivisions of the State.  The board
 
14 shall have the power[, as provided by law,] to formulate policy,
 
15 and to exercise control over the university through its executive
 
16 officer, the president of the university, who shall be appointed
 
17 by the board[; except that the].  The board shall also have
 
18 exclusive jurisdiction over the internal [organization and
 
19 management] structure, management, and operation of the

 1 university.  This section shall not limit the power of the
 
 2 legislature to enact laws of statewide concern.  The legislature
 
 3 shall have the exclusive jurisdiction to identify laws of
 
 4 statewide concern."
 
 5      SECTION 3.  The question to be printed on the ballot shall
 
 6 be as follows:
 
 7      "Shall the University of Hawaii have the authority and power
 
 8      of self-governance in matters involving only the internal
 
 9      structure, management, and operation of the university?"
 
10      SECTION 4.  Constitutional material to be repealed is
 
11 bracketed.  New constitutional material is underscored.
 
12      SECTION 5.  This amendment shall take effect upon compliance
 
13 with article XVII, section 3, of the Constitution of the State of
 
14 Hawaii, but in no event shall it take effect prior to July 1,
 
15 2050.
