                   A  BILL  FOR  AN  ACT

RELATING TO FIREWORKS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 132D-6, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "§132D-    County regulation.  Nothing in this chapter shall
 
 5 prevent a county from providing stricter regulation of fireworks
 
 6 than is provided under this chapter."
 
 7      SECTION 2.  Section 132D-17, Hawaii Revised Statutes, is
 
 8 repealed.
 
 9      ["[§132D-17]  Preemption.(a)  It is the intent of the
 
10 legislature to occupy the entire field of regulation in all
 
11 matters that are the subject of this chapter.
 
12      (b)  Notwithstanding any other law to the contrary, no
 
13 county shall enact any ordinances or adopt any rules, except as
 
14 required in section 132D-7 regulating fireworks.  All ordinances
 
15 and rules regulating fireworks, adopted by a county before
 
16 March 31, 1995, are declared null and void."]
 
17      SECTION 3.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
