                   A  BILL  FOR  AN  ACT

RELATING TO THE UNIVERSITY OF HAWAII.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that in order for the
 
 2 University of Hawaii to become a world class university and a
 
 3 focal point of the Pacific Rim, it is necessary that the
 
 4 university be headed by a board of regents that has a national
 
 5 and international perspective.  The purpose of this Act is to
 
 6 broaden the membership of the board of regents of the University
 
 7 of Hawaii from twelve to fifteen members and to require at least
 
 8 three board members to be nonresidents who are nationally or
 
 9 internationally prominent, whether in their chosen fields or
 
10 otherwise.
 
11      SECTION 2.  Section 26-11, Hawaii Revised Statutes, is
 
12 amended by amending subsection (a) to read as follows:
 
13      "(a)  The University of Hawaii shall be headed by an
 
14 executive board to be known as the board of regents.
 
15      [The board shall consist of twelve members.  No more than
 
16 six of the members shall be members of the same political party
 
17 and at least part of the membership of the board shall represent
 
18 geographic subdivisions of the State.  At least one member shall
 
19 be a University of Hawaii student at the time of the initial

 1 appointment.  This member may be reappointed for one additional
 
 2 term even though the member may no longer be a student at the
 
 3 time of reappointment.]
 
 4      The board shall have power, in accordance with the
 
 5 Constitution of the State and with law, to formulate policy, and
 
 6 to exercise control over the university through its executive
 
 7 officer, the president of the university.  The board shall have
 
 8 exclusive jurisdiction over the internal organization and
 
 9 management of the university."
 
10      SECTION 3.  Section 304-3, Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "§304-3 Regents; appointment; tenure; qualifications;
 
13 meetings.  (a)  The affairs of the university shall be under the
 
14 general management and control of the board of regents consisting
 
15 of [twelve] fifteen members who shall be appointed and may be
 
16 removed by the governor[.]; provided that:
 
17      (1)  No more than eight of the members shall be members of
 
18           the same political party and at least part of the
 
19           membership of the board shall represent geographic
 
20           subdivisions of the State.  Membership shall broadly
 
21           reflect economic, cultural, and social diversity;
 
22      (2)  At least three members shall be nonresidents who are
 
23           nationally or internationally prominent persons in

 1           their respective fields or otherwise.  These members
 
 2           shall be ex-officio, nonvoting members; and
 
 3      (3)  At least one member shall be a University of Hawaii
 
 4           student at the time of the initial appointment.  This
 
 5           member may be reappointed for one additional term even
 
 6           though the member may no longer be a student at the
 
 7           time of reappointment.
 
 8      (b)  The term of each member shall be for four years;
 
 9 provided that the term of the student member shall be for two
 
10 years.  Except as otherwise provided by statute, state officers
 
11 shall be eligible to appointment and membership.  Every member
 
12 may serve beyond the expiration date of the member's term of
 
13 appointment until the member's successor has been appointed and
 
14 has qualified.  
 
15      (c)  The board, at its first meeting after June 30, shall
 
16 elect a chairperson and vice-chairperson, who shall serve until
 
17 adjournment of its first meeting after June 30 of the next year
 
18 or thereafter until their successors are appointed and have
 
19 qualified and whose election shall be immediately certified by
 
20 the board to the chief election officer.  The board shall appoint
 
21 a secretary, who shall not be a member of the board.  The
 
22 president of the university shall act as executive officer of the
 
23 board.  The board shall meet not less often than ten times

 1 annually, and may from time to time meet in each of the counties
 
 2 of Hawaii, Maui, and Kauai[.]; provided that the board shall meet
 
 3 with the ex-officio, nonvoting members at least two times
 
 4 annually.
 
 5      (d)  The members of the board shall serve without pay but
 
 6 shall be entitled to their traveling expenses within the State
 
 7 when attending meetings of the board or when actually engaged in
 
 8 business relating to the work of the board."
 
 9      SECTION 4.  Statutory material to be repealed is bracketed.
 
10 New statutory material is underscored.
 
11      SECTION 5.  This Act shall take effect upon its approval.
