                   A  BILL  FOR  AN  ACT
RELATING TO TEACHERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purposes of this Act are to repeal the
 
 2 sunset date for the Hawaii teacher standards board and for the
 
 3 law providing for the issuance of certificates to teachers who
 
 4 are not required to obtain a license or credential from the
 
 5 teacher standards board; and to provide for staggered terms for
 
 6 board members.
 
 7      SECTION 2.  Section 302A-501, Hawaii Revised Statutes, is
 
 8 amended by amending subsection (b) to read as follows:
 
 9      "(b)  For the purposes of sections 302A-801 to 302A-808:
 
10      "Board" means the Hawaii teacher standards board.
 
11      "Credential" means an emergency or temporary license issued
 
12 under this chapter based on standards and guidelines set by the
 
13 board.
 
14      "License" means the document signifying the board's grant of
 
15 permission to practice the profession of teaching.
 
16      "Teacher" means an employee of the department paid under the
 
17 salary schedule contained in the unit 5 collective bargaining
 
18 agreement.
 
19      [This subsection is repealed on June 30, 2000.]"

 1      SECTION 3.  Section 302A-801, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  Appointed board members shall serve three-year
 
 4 terms[.]; provided that beginning July 1, 2000, the initial terms
 
 5 shall be staggered, as follows:
 
 6      (1)  Three members to serve three-year terms;
 
 7      (2)  Three members to serve two-year terms; and
 
 8      (3)  One member to serve a one-year term."
 
 9      SECTION 4.  Section 302A-809, Hawaii Revised Statutes, is
 
10 repealed.
 
11      ["[§302A-809]  Repeal.  This subpart D, sections 302A-801 to
 
12 302A-809, is repealed on June 30, 2000."]
 
13      SECTION 5.  Act 122, Session Laws of Hawaii 1996, is amended
 
14 by amending section 7 to read as follows:
 
15      "SECTION 7.  This Act shall take effect upon its approval,
 
16 except that section 2 shall take effect retroactive to July 1,
 
17 1995[, and shall be repealed on June 30, 2000]."
 
18      SECTION 6.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.'
 
20      SECTION 7.  This Act shall take effect upon its approval.
