                   A  BILL  FOR  AN  ACT

RELATING TO VIOLATION OF PRIVACY IN THE FIRST DEGREE.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 711-1110.9, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§711-1110.9[]]  Violation of privacy in the first
 
 4 degree.(1)  A person commits the offense of violation of
 
 5 privacy in the first degree if, except in the execution of a
 
 6 public duty or as authorized by law, the person intentionally or
 
 7 knowingly [installs]:
 
 8      (a)  Installs in any private place, without consent of the
 
 9           person or persons entitled to privacy therein, any
 
10           device for observing, photographing, videotaping,
 
11           filming, recording, amplifying, or broadcasting another
 
12           person in a stage of undress or sexual activity in that
 
13           place[, or uses];
 
14      (b)  Uses any [such] unauthorized installation[.] as
 
15           described in paragraph (a); or
 
16      (c)  Distributes or sells any material relating to the
 
17           unauthorized installation described in paragraph (a).
 
18      (2)  Notwithstanding section 701-108(2)(c), a prosecution

 1 under this section must be commenced within six years after the
 
 2 offense is committed.
 
 3      [(2)] (3)  Violation of privacy in the first degree is a
 
 4 class C felony."
 
 5      SECTION 2.  This Act shall apply to any proceeding that has
 
 6 not yet commenced before its effective date.
 
 7      SECTION 3.  Statutory material to be repealed is bracketed.
 
 8 New statutory material is underscored.
 
 9      SECTION 4.  This Act shall take effect upon its approval.
