                   A  BILL  FOR  AN  ACT

RELATING TO CYBER-TERRORISM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 708-890, Hawaii Revised Statutes, is
 
 2 amended by adding seven new definitions to be appropriately
 
 3 inserted and to read as follows:
 
 4      ""Cyber-terrorism" means to:
 
 5      (1)  Threaten by word or conduct;
 
 6      (2)  Cause bodily injury to another person or serious damage
 
 7           to property of another;
 
 8      (3)  Commit a felony with the intent to terrorize, or in
 
 9           reckless disregard of the risk of terrorizing, another
 
10           person; or
 
11      (4)  Threaten with intent to cause, or in reckless disregard
 
12           of the risk of causing, evacuation of a building, place
 
13           of assembly, or facility of public transportation, by
 
14           computer.
 
15      "Domain name" means the alias for an internet protocol
 
16 address.
 
17      "Internet service provider" means an entity that provides
 
18 access services to the internet.
 
19      "E-mail" means electronic mail.

 1      "Internet" means the electronic network of computers across
 
 2 the world that work together to share information.
 
 3      "Law enforcement officer" means police officers,
 
 4 prosecutors, government criminal investigators, and judges.
 
 5      "Personal information" means a social security number,
 
 6 employer identification number, financial account numbers, date
 
 7 of birth, driver's license identification, or any other
 
 8 identification that is proprietary to an individual person."
 
 9      SECTION 2.  Chapter 708, Hawaii Revised Statutes, is amended
 
10 by adding two new sections to be appropriately designated and to
 
11 read as follows:
 
12      "§708-     Cyber-terrorism of a law enforcement officer.
 
13 (1)  A person commits the offense of cyber-terrorism of a law
 
14 enforcement officer if, without the consent of the law
 
15 enforcement officer, and with the intent to threaten, harass,
 
16 annoy, or alarm a law enforcement officer, or in reckless
 
17 disregard of the risk thereof, that person:
 
18      (a)  Constructs, establishes, or maintains a website on the
 
19           internet, or transmits e-mail, with the personal
 
20           information of the law enforcement officer;
 
21      (b)  Possesses personal information about the law
 
22           enforcement officer obtained from the internet; or
 
23      (c)  Assumes the law enforcement officer's personal

 1           information with the intent to threaten, harass, annoy,
 
 2           or alarm a law enforcement officer, or any other person
 
 3           related to the law enforcement officer.
 
 4      (2)  An internet service provider, with its identified
 
 5 domain name, commits the offense of cyber-terrorism of a law
 
 6 enforcement officer if the internet service provider:
 
 7      (a)  Assists in, or establishes the construction or
 
 8           maintenance of, a website that allows the personal
 
 9           information of a law enforcement officer to be viewed
 
10           on the internet; and
 
11      (b)  After three written warnings to the internet service
 
12           provider, the internet service provider refuses to
 
13           remove the personal information of a law enforcement
 
14           officer and continues to recklessly allow personal
 
15           information of a law enforcement officer to be
 
16           accessible from the internet service provider's site.
 
17      (3)  Cyber-terrorism of a law enforcement officer is a class
 
18 B felony.
 
19      §708-     Cyber-terrorism.  (1)  A person commits the
 
20 offense of cyber-terrorism if, without the consent of another, a
 
21 person assumes the personal information of another and utilizes
 
22 the personal information of another on the internet and e-mail
 
23 with the intent to threaten, harass, annoy, or alarm another or

 1 any other person.
 
 2      (2)  An internet service provider, with its identified
 
 3 domain name, commits the offense of cyber-terrorism if the
 
 4 internet service provider:
 
 5      (a)  Assists in, or establishes the construction or
 
 6           maintenance of, a website that allows the personal
 
 7           information of another to be viewed on the internet;
 
 8           and
 
 9      (b)  After three written warnings to the internet service
 
10           provider, the internet service provider refuses to
 
11           remove the personal information of another and
 
12           continues to recklessly allow personal information of
 
13           another to be accessible from the internet service
 
14           provider's site.
 
15      (3)  Cyber-terrorism is a class C felony."
 
16      SECTION 3.  This Act does not affect rights and duties that
 
17 matured, penalties that were incurred, and proceedings that were
 
18 begun, before its effective date.
 
19      SECTION 4.  New statutory material is underscored.
 
20      SECTION 5.  This Act shall take effect upon its approval.
