                   A  BILL  FOR  AN  ACT

RELATING TO FOREST STEWARDSHIP. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 183-16, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  Any moneys accrued from:
 
 4      (1)  The harvest of non-native forest products from forest
 
 5           reserves;
 
 6     [(2)  The harvest of native forest products from degraded
 
 7           forests as defined in section 186-5.5, within forest
 
 8           reserves;
 
 9      (3)] (2)  The sale of forest products found dead and lying
 
10           on the ground; or
 
11     [(4)] (3) The sale of tree seedlings from state nurseries;
 
12 shall be deposited into the forest stewardship fund."
 
13      SECTION 2.  Section 195F-4, Hawaii Revised Statutes, is
 
14 amended by amending subsection (a) to read as follows:
 
15      "(a)  There is established a special fund within the state
 
16 treasury known as the forest stewardship fund which shall be used
 
17 as follows:
 
18      (1)  Payments shall be made by the board pursuant to
 
19           agreements entered into with qualified landowners to

 1           further the purposes of this chapter; and
 
 2      (2)  Moneys collected from the harvest of non-native forest
 
 3           products from forest reserves, [from the harvest of
 
 4           native forest products from degraded forests as defined
 
 5           in section 186-5.5, within forest reserves,] from
 
 6           forest products found dead and lying on the ground, or
 
 7           from the sale of tree seedlings from the state
 
 8           nurseries, shall be used for the following activities:
 
 9           (A)  Replanting, managing, and maintaining designated
 
10                timber management areas;
 
11           (B)  Enhancing the management of public forest reserves
 
12                with an emphasis on restoring degraded koa
 
13                forests; and
 
14           (C)  Developing environmental education and training
 
15                programs pertaining to sustainable forestry;
 
16           provided that funding for the purposes described in
 
17           subparagraphs (B) and (C) may not occur unless the
 
18           activities described in approved management plans
 
19           pertaining to subparagraph (A) are adequately funded."
 
20      SECTION 3.  Statutory material to be repealed is bracketed.
 
21 New statutory material is underscored.
 
22      SECTION 4.  This Act shall take effect upon its approval.
