                   A  BILL  FOR  AN  ACT

RELATING TO SECONDHAND DEALERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 445-171, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§445-171  Fee, conditions.  The treasurer may grant
 
 4 licenses to suitable persons to be dealers and traders in
 
 5 secondhand articles, and may revoke such licenses for cause
 
 6 satisfactory to the treasurer.  The licensees shall pay to the
 
 7 treasurer an annual fee of $10.
 
 8      Every license granted under this section shall designate the
 
 9 place where the business is carried on and shall continue for one
 
10 year unless sooner revoked.  Every dealer shall keep a book in
 
11 which shall be written a description of every article received,
 
12 the name, residence, thumbprint, and a general description of the
 
13 person from whom, and the time and hour when the article was
 
14 received.  The book, the place where the business is carried on,
 
15 and the articles of property therein, may be examined at any time
 
16 by the treasurer, the chief of police, or by any person
 
17 presenting to such dealer a written authorization so to do from
 
18 the treasurer or chief of police."
 
19      SECTION 2.  This Act does not affect rights and duties that

 1 matured, penalties that were incurred, and proceedings that were
 
 2 begun, before its effective date.
 
 3      SECTION 3.  New statutory material is underscored.
 
 4      SECTION 4.  This Act shall take effect upon its approval.
