                   A  BILL  FOR  AN  ACT
RELATING TO THE HAWAII PUBLIC EMPLOYEES HEALTH FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 87-11, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§87-11  Composition of board.  The board of trustees shall
 
 4 consist of [nine trustees, three of whom shall be representatives
 
 5 from different organizations representing public employees, three
 
 6 from different private business organizations, a member of the
 
 7 clergy, a teacher, and the director of finance or a designated
 
 8 representative.] an equal number of employee and public employer
 
 9 representatives.  The employee representatives shall consist of
 
10 one representative from each of the organizations certified as an
 
11 exclusive representative for state and county employees and one
 
12 retiree of the employees' retirement system to be elected by the
 
13 members and retirees of the system under rules adopted by the
 
14 board governing the election to serve for a term of six years to
 
15 expire on January 1 of the sixth year; provided that, if after
 
16 the close of filing of petitions for candidacy, a member is
 
17 unopposed for election to a trustee position, the member shall be
 
18 deemed and declared to be duly and legally elected to the
 
19 position of trustee without an election.  The public employer
 
20 representatives shall consist of two representatives from the

 1 State appointed by the governor, one representative from the
 
 2 judiciary to be appointed by the chief justice, and a
 
 3 representative from each of the four counties appointed by the
 
 4 mayors of the respective counties.  If the number of employee
 
 5 organizations changes, and there is a need for a reduction or
 
 6 increase in the number of employer representatives, the employer
 
 7 representatives listed above shall determine which jurisdiction
 
 8 representatives shall be deleted or added."
 
 9      SECTION 2.  Section 87-13, Hawaii Revised Statutes, is
 
10 amended to read as follows:
 
11      "§87-13  Term of a trustee; vacancy.  [Except for the
 
12 director of finance, the] The term of office of [each trustee]
 
13 the retiree shall be [four] six years.  The [director of finance]
 
14 respective public employer and employee organization
 
15 representatives shall serve [during the director's term of office
 
16 as director of finance.] at the discretion of the appointing
 
17 officer or the employee organization director, respectively.
 
18      A vacancy on the retiree position on the board [of trustees]
 
19 shall be filled by appointment of the governor[.] if fewer than
 
20 two years remain of the retiree's term.  If more than two years
 
21 remain of the retiree's term, a new election shall be held
 
22 pursuant to section 87-11 to fill the vacancy.  The person
 
23 appointed to fill a vacancy shall serve for the remainder of the

 1 term of the person's predecessor.
 
 2      If by the end of the trustee's term a trustee is not
 
 3 reappointed or the trustee's successor is not appointed, the
 
 4 trustee shall serve until the trustee's successor is appointed."
 
 5      SECTION 3.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 4.  This Act shall take effect upon its approval.
