DESCRIPTION:
Exempts insects obtained directly from commercial insectaries
certified by the DOA from inspection upon their entry into the
State.  Establishes a revolving fund for use by the DOA in
providing inspection services to certify the quality and

                   A  BILL  FOR  AN  ACT

RELATING TO PLANT AND NON-DOMESTIC ANIMAL QUARANTINE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 150A, Hawaii Revised Statutes, is
 
 2 amended by adding two new sections to be appropriately designated
 
 3 and to read as follows:
 
 4      "§150A-     Commercial insectaries inspection and
 
 5 certification revolving fund.  (a)  There is established a
 
 6 revolving fund for use by the department in providing inspection
 
 7 services to certify the quality and sanitation of commercial
 
 8 insectaries located within the continental United States.  Moneys
 
 9 in the revolving fund may be expended for materials, salaries,
 
10 equipment, training, and other costs related to providing the
 
11 inspection and certification services.
 
12      (b)  The department shall fix, assess, and collect fees for
 
13 the inspection and certification services provided.  The fees
 
14 shall be in an amount necessary to cover all costs related to the
 
15 administration and provision of the inspection and certification
 
16 services; provided that the department shall establish charges
 
17 for traveling expenses and extraordinary services when the
 
18 performance of the services involves unusual cost in their
 
19 performance.  The fees and charges established by the department

 1 shall be exempt from the public notice and public hearing
 
 2 requirements of chapter 91.
 
 3      (c)  Moneys derived from the inspection and certification
 
 4 services provided shall be deposited in the revolving fund.
 
 5 Inspectors appointed under this section shall be exempt from
 
 6 chapters 76 and 77.
 
 7      (d)  The department may accept gifts from persons, which
 
 8 shall be paid into the revolving fund, to cover specific costs
 
 9 related to the administration and provision of the inspection and
 
10 certification services described in subsection (a); provided that
 
11 a gift shall be expended in accordance with the provisions of the
 
12 instrument of gift.
 
13      (e)  The department shall adopt rules, including penalties,
 
14 to carry out the purposes of this section.
 
15      §150A-     Importation of insects obtained from certified
 
16 commercial insectaries.  (a)  Notwithstanding section 150A-5 to
 
17 the contrary, insects obtained directly from commercial
 
18 insectaries certified by the department pursuant to section 150A-
 
19     shall not be subject to inspection upon their entry into the
 
20 State.
 
21      (b)  Subsection (a) shall not apply if the chairperson finds
 
22 that shipments from a certified commercial insectary are likely
 
23 to cause imminent harm to agriculture, horticulture, animal or

 1 public health, natural resources, including native biota, or the
 
 2 environment."
 
 3      SECTION 2.  There is appropriated out of the general
 
 4 revenues of the State of Hawaii the sum of $        , for fiscal
 
 5 year 2000-2001, to be paid into the commercial insectaries
 
 6 inspection and certification revolving fund created in section 1
 
 7 of this Act.  The sum appropriated shall be expended by the
 
 8 department of agriculture for the purposes of the revolving fund.
 
 9      SECTION 3.  There is appropriated out of the general
 
10 revenues of the State of Hawaii the sum of $        , or so much
 
11 thereof as may be necessary for fiscal year 2000-2001, to review
 
12 additional insect species that may be beneficial to agriculture,
 
13 horticulture, animal or public health, natural resources,
 
14 including native biota, or the environment, for placement on the
 
15 lists of conditionally approved animals, restricted animals, or
 
16 prohibited animals.  The sum appropriated shall be expended by
 
17 the department of agriculture.
 
18      SECTION 4.  New statutory material is underscored.
 
19      SECTION 5.  This Act shall take effect on July 1, 2000.
