DESCRIPTION:
This bill authorizes the director of finance to issue $3,988,000
in general obligation bonds.  The funds raised will implement the

                   A  BILL  FOR  AN  ACT

RELATING TO AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS
   AND MAKING AN APPROPRIATION FOR THE WAILUPE STREAM FLOOD
   CONTROL PROJECT. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Flooding on New Year's day of 1988 caused untold
 
 2 millions of dollars of property damage and immeasurable personal
 
 3 grief for East Honolulu residents. Homes were flooded, cars
 
 4 pushed down streets and overturned, and hundreds of people
 
 5 traumatized by the damage caused to their community.  Only the
 
 6 timely response of civil defense workers and serendipity
 
 7 prevented a loss of life that day.
 
 8      The legislature finds that despite county public
 
 9 improvements, the lack of permanent measures to address the
 
10 Wailupe Stream drainage problem is disturbing.  Until permanent
 
11 measures are taken, homes within the flood plain are jeopardized.
 
12 Currently, natural factors, such as debris accumulation and
 
13 siltation, will decrease Wailupe Stream's capacity.  This invites
 
14 a potential repeat of New Year's day 1988, a day no East Honolulu
 
15 resident wants to re-live.
 
16      Allowing the Wailupe Stream situation to go unaddressed is
 
17 currently contributing to a number of problems, including: the
 
18 potential structural damage to bridges spanning Wailupe Stream
 
19 due to floating debris and the subsequent isolation of East

 1 Honolulu,  and degradation of Maunalua Bay's water quality,
 
 2 damage to nearshore reefs and abutting embankment lots.
 
 3 The purpose of this bill is to implement the Wailupe Stream Flood
 
 4 Control Project through the authorization to issue $3,988,000 in
 
 5 general obligation bonds.
 
 6      SECTION 2.  The director of finance is authorized to issue
 
 7 general obligation bonds in the sum of $3,988,000, or so much
 
 8 thereof as may be necessary, and the same sum, or so much thereof
 
 9 as may be necessary, is appropriated for fiscal year 2000-2001
 
10 for the Wailupe Stream Flood Control Project, to be expended as
 
11 follows:.
 
12      Plans                                  1,000,000
 
13      Design                                 1,500,000
 
14      Construction                           1,488,000
 
15      Total Funding                          3,988,000
 
16      SECTION 3.  The appropriation made for the capital
 
17 improvement project authorized in this Act shall not lapse at the
 
18 end of the fiscal year for which the appropriation is made;
 
19 provided that all moneys from the appropriation unencumbered as
 
20 of June 30, 2003, shall lapse as of that date.
 
21      SECTION 4.  The sum appropriated shall be expended by the
 
22 Department of Land and Natural Resources for the purpose of this
 
23 Act; provided that the chairperson of the board of Land and

 1 Natural Resources:
 
 2           (1)  Shall utilize county and federal funds for the
 
 3                Wailupe Stream Flood Control project if these
 
 4                funds are available; and
 
 5           (2)  May allow the Department of Land and Natural
 
 6                Resources to assume the title of "local sponsor",
 
 7                should the need arise, to qualify for federal
 
 8                funds and appropriations.
 
 9      SECTION 5.  This Act shall take effect on July 1, 2000.
