                   A  BILL  FOR  AN  ACT

RELATING TO TRAFFIC RECORDS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  A driver's traffic record plays an increasingly
 
 2 important role in a person's day-to-day life.  An inaccurate
 
 3 traffic record may cause difficulties in obtaining motor vehicle
 
 4 insurance and in addition, may cause the improper
 
 5 characterization of a person applying for a job or financial
 
 6 loan.  In order to ensure that all traffic records are accurate,
 
 7 records should automatically be expunged at no cost to the driver
 
 8 where the driver who is charged with a violation is later found
 
 9 to be innocent.
 
10      The purpose of this Act is to provide for the automatic
 
11 expungement of a driver's traffic record of violations for which
 
12 the driver is later found innocent, at no cost to the driver.
 
13      SECTION 2.  Chapter 286, Part VIII, Hawaii Revised Statutes,
 
14 is amended by adding a new section to be appropriately designated
 
15 and to read as follows:
 
16      "§286-    Expungement of traffic records.  The traffic
 
17 record of any person licensed to drive in this State, who
 
18 allegedly commits a violation of the State's traffic laws but is
 
19 later found to be innocent of the alleged violations, shall

 1 automatically be expunged.  The expungement shall take place at
 
 2 no cost to the driver with the alleged violations."
 
 3      SECTION 3.  New statutory material is underscored.
 
 4      SECTION 4.  This Act shall take effect upon its approval.
