                   A  BILL  FOR  AN  ACT

RELATING TO CORRECTIONAL HEALTH CARE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that providing for the
 
 2 health care needs of inmates is a priority for the department of
 
 3 public safety.  As inmates are wards of the State, health
 
 4 services in correctional facilities should be maintained at a
 
 5 standard for health care consistent with that found in a
 
 6 community.  This responsibility requires a program administrator
 
 7 and physicians who are not only experts in the profession, but
 
 8 who also understand the unique aspects of delivering health care
 
 9 services in a correctional environment.  Program administrators
 
10 and physicians who possess these dual qualities demand greater
 
11 compensation than others, often beyond what the civil service pay
 
12 scale allows due to the unusual work conditions and
 
13 characteristics of the clientele.  In light of this, to hire
 
14 qualified health care administrators and physicians to provide
 
15 health services, the department resorts to contracting for the
 
16 purchase of professional services.
 
17      The purpose of this Act is to allow the department of public
 
18 safety to hire a program administrator and physicians based on
 
19 specialized abilities and to provide that the program

 1 administrator and physician positions shall be exempt from the
 
 2 civil service process.
 
 3      SECTION 2.  Chapter 353C, Hawaii Revised Statutes, is
 
 4 amended by adding a new section to be appropriately designated
 
 5 and to read as follows:
 
 6      "§353C-     Correctional health care program.  There is
 
 7 established a correctional health care program within the
 
 8 department.  The administrator of the correctional health care
 
 9 program and physicians who provide care to inmates shall be
 
10 appointed by the director without regard to chapters 76 and 77."
 
11      SECTION 3.  New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
