Hunting Licenses


DESCRIPTION:
Increases nonresident hunting license fees.  Requires applicants
for a license to disclose if they are prohibited from using
firearms for hunting.  Allows DLNR to establish hunting license
application and issuance procedures and set fees through

                   A  BILL  FOR  AN  ACT

RELATING TO HUNTING LICENSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 183D, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to part II to be appropriately
 
 3 designated and to read as follows:
 
 4      "§183D-    Applications and issuance of hunting licenses;
 
 5 paternity and child support.  The department shall suspend,
 
 6 refuse to renew, reinstate, or restore, or deny any hunting
 
 7 license if the department has received certification from the
 
 8 child support enforcement agency pursuant to section 576D-13 that
 
 9 the licensee or applicant is not in compliance with an order of
 
10 support or has failed to comply with a subpoena or warrant
 
11 relating to a paternity or child support proceeding.  The
 
12 department shall issue, renew, restore, or reinstate such a
 
13 license only upon receipt of an authorization from the child
 
14 support enforcement agency, the office of child support hearings,
 
15 or the family court."
 
16      SECTION 2.  Section 183D-3, Hawaii Revised Statutes, is
 
17 amended to read as follows:
 
18      "§183D-3  Rules.  Subject to chapter 91, the department
 
19 shall adopt, amend, and repeal rules:

 1      (1)  Concerning the preservation, protection, regulation,
 
 2           extension, and utilization of, and conditions for entry
 
 3           into wildlife sanctuaries, game management areas, and
 
 4           public hunting areas designated by the department;
 
 5      (2)  Protecting, conserving, monitoring, propagating, and
 
 6           harvesting wildlife;
 
 7      (3)  Concerning size limits, bag limits, open and closed
 
 8           seasons, and specifications of hunting gear which may
 
 9           be used or possessed; [and]
 
10      (4)  Setting fees for activities permitted under this
 
11           chapter, unless otherwise provided by law[.]; and
 
12      (5)  To carry out other purposes of this chapter.
 
13 The rules may vary from county to county or in any part of the
 
14 county and may specify certain days of the week or certain hours
 
15 of the day in designating open seasons, except that any fees
 
16 established by rule shall be the same for each county.  All rules
 
17 shall have the force and effect of law."
 
18      SECTION 3.  Section 183D-22, Hawaii Revised Statutes, is
 
19 amended by amending subsections (a) and (b) to read as follows:
 
20      "(a)  A hunting license shall be issued to a person by an
 
21 agent of the department upon:
 
22      (1)  Written application in the form prescribed by the
 
23           department;

 1      (2)  Payment of a hunting license fee or any other hunting
 
 2           related fee the board may require as provided in this
 
 3           chapter; except that payment of the fee shall be waived
 
 4           for any employee of the department who is required to
 
 5           have a license to carry out duties of the department;
 
 6           and
 
 7      (3)  Showing a valid Hawaii hunter education certificate or
 
 8           written exemption issued under section 183D-28 or upon
 
 9           showing proof of completion of an approved hunter
 
10           education course described in section 183D-28(b)(2).
 
11 The application shall require a statement under oath of the
 
12 applicant's name, address, domicile or residence, length of
 
13 residence in the State, age, race, height, weight, and color of
 
14 hair and eyes[.], and if prohibited from using firearms.
 
15      (b)  The hunting license fee shall be:
 
16      (1)  $10 for any person who has resided in the State for one
 
17           year or longer, or who is a member of the armed forces
 
18           of the United States on active duty and the spouse and
 
19           children thereof, or who elects to forgo the exemption
 
20           provided in paragraph (3);
 
21      (2)  [$95 for] For all other persons[;]:
 
22           (A)  $215 for a combination game bird and game mammal

 1           (B)  $160 for a game mammal license; and
 
 2           (C)  $105 for a game bird license; and
 
 3      (3)  Free to all Hawaii residents sixty-five years of age or
 
 4           older and to all persons with Hansen's disease who are
 
 5           residents of Kalaupapa, Molokai."
 
 6      SECTION 4.  Section 183D-22, Hawaii Revised Statutes, is
 
 7 repealed as provided in section 6 of this Act and in the form in
 
 8 which it reads on the date of the repeal.
 
 9      SECTION 5.  Statutory material to be repealed is bracketed.
 
10 New statutory material is underscored.
 
11      SECTION 6.  This Act shall take effect on July 1, 2000;
 
12 provided that sections 1 and 4 of this Act shall take effect upon
 
13 the effective date of administrative rules by the department of
 
14 land and natural resources pertaining to the application and
 
15 issuance of hunting licenses, including the establishment of
 
16 hunting license fees.
