DESCRIPTION:
Increases nonresident hunting license fees.  Requires applicants
for a license to disclose if they are prohibited from using

                   A  BILL  FOR  AN  ACT

RELATING TO HUNTING LICENSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 183D, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to part II to be appropriately
 
 3 designated and to read as follows:
 
 4      "§183D-    Applications and issuance of hunting licenses;
 
 5 paternity and child support.  The department shall suspend,
 
 6 refuse to renew, reinstate, or restore, or deny any hunting
 
 7 license if the department has received certification from the
 
 8 child support enforcement agency pursuant to section 576D-13 that
 
 9 the licensee or applicant is not in compliance with an order of
 
10 support or has failed to comply with a subpoena or warrant
 
11 relating to a paternity or child support proceeding.  The
 
12 department shall issue, renew, restore, or reinstate such a
 
13 license only upon receipt of an authorization from the child
 
14 support enforcement agency, the office of child support hearings,
 
15 or the family court."
 
16      SECTION 2.  Section 183D-22, Hawaii Revised Statutes, is
 
17 amended by amending subsections (a) and (b) to read as follows:
 
18      "(a)  A hunting license shall be issued to a person by an
 
19 agent of the department upon:

 1      (1)  Written application in the form prescribed by the
 
 2           department;
 
 3      (2)  Payment of a hunting license fee or any other hunting
 
 4           related fee the board may require as provided in this
 
 5           chapter; except that payment of the fee shall be waived
 
 6           for any employee of the department who is required to
 
 7           have a license to carry out duties of the department;
 
 8           and
 
 9      (3)  Showing a valid Hawaii hunter education certificate or
 
10           written exemption issued under section 183D-28 or upon
 
11           showing proof of completion of an approved hunter
 
12           education course described in section 183D-28(b)(2).
 
13 The application shall require a statement under oath of the
 
14 applicant's name, address, domicile or residence, length of
 
15 residence in the State, age, race, height, weight, and color of
 
16 hair and eyes[.], and if prohibited from using firearms.
 
17      (b)  The hunting license fee shall be:
 
18      (1)  $10 for any person who has resided in the State for one
 
19           year or longer, or who is a member of the armed forces
 
20           of the United States on active duty and the spouse and
 
21           children thereof, or who elects to forgo the exemption
 
22           provided in paragraph (3);

 1      (2)  [$95 for] For all other persons[;]:
 
 2           (A)  $215 for a combination game bird and game mammal
 
 3                license;
 
 4           (B)  $160 for a game mammal license; and
 
 5           (C)  $105 for a game bird license; and
 
 6      (3)  Free to all Hawaii residents sixty-five years of age or
 
 7           older and to all persons with Hansen's disease who are
 
 8           residents of Kalaupapa, Molokai."
 
 9      SECTION 3.  Statutory material to be repealed is bracketed.
 
10 New statutory material is underscored.
 
11      SECTION 4.  This Act shall take effect on July 1, 2000.
