                   A  BILL  FOR  AN  ACT

RELATING TO THE WATER RESOURCE MANAGEMENT FUND.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 174C, Hawaii Revised Statutes, is
 
 2 amended by adding to part I a new section to be appropriately
 
 3 designated and to read as follows:
 
 4      "§174C-    Water resource management fund.  (a)  There is
 
 5 established in the department a special fund to be designated as
 
 6 the water resource management fund.  The fund shall be
 
 7 administered by the commission.  The water resource management
 
 8 fund shall be used for the following:
 
 9      (1)  Monitoring programs and activities concerning water
 
10           resource quality, protection, and management;
 
11      (2)  Research programs and activities concerning water
 
12           conservation and investigation of alternative sources
 
13           of water;
 
14      (3)  Preparation and dissemination of information to the
 
15           public concerning activities authorized under this
 
16           chapter;
 
17      (4)  Data collection, development, and updating of long-
 
18           range planning documents authorized under this chapter;
 
19           and
 
20      (5)  Any other protection, management, operational, or

 1           maintenance functions authorized and deemed necessary
 
 2           by the commission, including but not limited to funding
 
 3           permanent or temporary staff positions.
 
 4      (b)  Subject to the Hawaiian Homes Commission Act of 1920,
 
 5 as amended, and section 5(f) of the Admission Act of 1959, as
 
 6 implemented by Article XII, section 6, of the State Constitution,
 
 7 the following shall be deposited into the water resource
 
 8 management fund:
 
 9      (1)  Appropriations by the legislature to the water resource
 
10           management fund;
 
11      (2)  All fees and administrative charges collected under
 
12           this chapter or any rule adopted thereunder;
 
13      (3)  Moneys collected as fines or penalties imposed under
 
14           this chapter or any rule adopted thereunder;
 
15      (4)  Moneys derived from public and private sources to
 
16           benefit water resource protection and management;
 
17      (5)  Any moneys collected from the sale of retail items by
 
18           the department related to water resources;
 
19      (6)  Any other moneys collected pursuant to chapter 174C;
 
20           and
 
21      (7)  Moneys derived from interest, dividend, or other income
 
22           from the above sources."
 
23      SECTION 2.  There is appropriated out of the water

 1 resource management fund the sum of $25,000 or so much thereof
 
 2 as may be necessary for fiscal year 2000-2001, to be expended
 
 3 by the department of land and natural resources for the
 
 4 purposes of the water resource management fund.
 
 5      SECTION 3.  New statutory material is underscored.
 
 6      SECTION 4.  This Act shall take effect on July 1, 2000.
