                   A  BILL  FOR  AN  ACT

MAKING AN EMERGENCY APPROPRIATION FOR THE STATE'S MEDICAID HOME 
   AND COMMUNITY BASED SERVICES FOR THE DEVELOPMENTALLY
   DISABLED OR MENTALLY RETARDED PROGRAM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  This Act is recommended by the governor for
 
 2 immediate passage in accordance with section 9 of article VII of
 
 3 the Constitution of the State of Hawaii.
 
 4       SECTION 2.  The purpose of this Act is to appropriate and
 
 5 authorize additional funds for the State's medicaid home and
 
 6 community-based care services for the developmentally disabled or
 
 7 mentally retarded program, also known as a Title XIX waiver
 
 8 program, within the department of health.  The additional funds
 
 9 will support current clients, provide for the admission of more
 
10 people to the program, and address issues raised by Makin v.
 
11 State of Hawaii, U.S. Dist. Ct., Civil No. 98-00997 DAE.
 
12      SECTION 3.  The sum of $1,817,128 or so much thereof as may
 
13 be necessary for fiscal year 1999-2000 is appropriated or
 
14 authorized, as the case may be, from moneys in the treasury
 
15 received from general revenues and federal funds, unless
 
16 otherwise specified and in the following manner:
 
17      (1)  The department of health (HTH 501 CN)          $367,268
 
18           To provide general revenues for the State's
 
19           share of funds for the State's medicaid home

 1           and community-based care services for the
 
 2           developmentally disabled or mentally retarded
 
 3           program, in addition to the $10,960,669
 
 4           appropriated for that purpose as part of the
 
 5           appropriation for HTH 501 by part II, section
 
 6           3, item E-8 of Act 91, Session Laws of Hawaii
 
 7           1999; provided that no funds shall be made
 
 8           available under this Act unless the federal
 
 9           government provides match funding for 51.01
 
10           per cent of the program for which this sum is
 
11           appropriated.
 
12      (2)  The department of human services (HMS 603)     $958,472
 
13           To increase the federal match funds for the
 
14           State's medicaid home and community-based
 
15           care services for the developmentally
 
16           disabled or mentally retarded program, in
 
17           addition to the $21,479,723 authorized for
 
18           that purpose as part of the appropriation for
 
19           HMS 603 by part II, section 3, item F-25 of
 
20           Act 91, Session Laws of Hawaii 1999.
 
21      (3)  The department of human services (HMS 603)     $491,388
 
22           To increase the interdepartmental transfer
 
23           funds for the State's medicaid home and

 1           community-based care services for the
 
 2           developmentally disabled or mentally retarded
 
 3           program, in addition to the $10,836,549
 
 4           authorized for that purpose as part of the
 
 5           appropriation for HMS 603 by part II, section
 
 6           3, item F-25 of Act 91, Session Laws of
 
 7           Hawaii 1999.
 
 8      SECTION 4.  The sum appropriated shall be expended as
 
 9 indicated in section 3 by the department of health and the
 
10 department of human services for the purposes of this Act.
 
11      SECTION 5.  This Act shall take effect upon its approval.
