                   A  BILL  FOR  AN  ACT

RELATING TO SOLID WASTE MANAGEMENT DISPOSAL SURCHARGE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 342G-1, Hawaii Revised Statutes, is
 
 2 amended by adding two new definitions to be appropriately
 
 3 inserted and to read as follows:
 
 4      ""Construction and demolition waste" means solid waste,
 
 5 largely inert waste, resulting from the demolition or razing of
 
 6 buildings, of roads, or other structures, including but not
 
 7 limited to, concrete, rock, brick, bituminous concrete, lumber,
 
 8 masonry, composition roofing and roofing paper, steel, plaster,
 
 9 minor amounts of metals, and residual amounts of waste paints,
 
10 solvents, sealers, adhesives, or similar materials.
 
11      "Inert waste" means solid waste, which is limited to earth
 
12 and earth-like products, concrete, cured asphalt, rock, bricks,
 
13 and material which will not cause a leachate of environmental
 
14 concern."
 
15      SECTION 2.  Section 342G-62, Hawaii Revised Statutes, is
 
16 amended by amending subsection (a) to read as follows:
 
17      "(a)  There is established a solid waste management
 
18 surcharge.  The solid waste management surcharge shall be [35] 60
 
19 cents per ton of solid waste disposed of within the State at

 1 permitted or unpermitted solid waste disposal facilities[.],
 
 2 except that the surcharge shall be 35 cents per ton of solid
 
 3 waste disposed of at permitted inert or construction and
 
 4 demolition waste disposal facilities.  The surcharge shall be
 
 5 paid by the [person or entity doing the disposal.] owner or
 
 6 operator of the disposal facility.  The owner or operator of the
 
 7 facility shall transfer all moneys collected from the surcharge
 
 8 to the department through a quarterly reporting and payment
 
 9 schedule.  Estimates of quarterly solid waste disposal shall be
 
10 submitted prior to the first day of each quarter and the transfer
 
11 of moneys collected shall occur within thirty days of the end of
 
12 each quarter."
 
13      SECTION 3.  Statutory material to be repealed is bracketed.
 
14 New statutory material is underscored.
 
15      SECTION 4.  This Act shall take effect on July 1, 2000.
