                   A  BILL  FOR  AN  ACT

RELATING TO ADVANCE HEALTH-CARE DIRECTIVES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 286, Hawaii Revised Statutes is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§286-    Designation of advance health-care directive.  On
 
 5 the application form for any motor vehicle license or license
 
 6 renewal, the examiner of drivers shall ask the applicant to
 
 7 designate whether the applicant has an advance health-care
 
 8 directive.  The examiner of drivers shall issue or renew a
 
 9 license bearing the designation "advance health-care directive,"
 
10 a symbol or an abbreviation thereof, for those applicants who
 
11 have so indicated.  For purposes of this section, "advance
 
12 health-care directive" means an individual instruction in
 
13 writing, a living will, or a durable power of attorney for health
 
14 care.  No specific medical treatment information shall be
 
15 imprinted on the motor vehicle license."
 
16      SECTION 2.  Section 846-28, Hawaii Revised Statutes, is
 
17 amended to read as follows:
 
18      "§846-28  Information to be secured.  (a)  The department of
 
19 the attorney general shall require, collect, secure, make, and

 1 maintain a record of the following items of information so far as
 
 2 it is practicable to secure the same, with respect to each
 
 3 applicant for registration:
 
 4      (1)  The name of the person applying to be registered
 
 5           (hereinafter called the "registrant" or "applicant"),
 
 6           the street and number or address of the applicant's
 
 7           place of permanent residence, and the applicant's
 
 8           residence and business telephone numbers, if any;
 
 9      (2)  The applicant's occupation and any pertinent data
 
10           relating thereto;
 
11      (3)  The applicant's racial extraction;
 
12      (4)  The applicant's citizenship;
 
13      (5)  The date and place of the applicant's birth;
 
14      (6)  The applicant's personal description including sex,
 
15           height, weight, hair, eyes, complexion, build, scars,
 
16           and marks;
 
17      (7)  The applicant's right and left index fingerprints or,
 
18           if the applicant has no right index finger or left
 
19           index finger, other identifying imprint as specified by
 
20           rules of the department; provided that this requirement
 
21           shall not apply to minors until they reach the age of
 
22           three years;
 
23      (8)  The name, relationship, and address of the nearest

 1           relative or other person to be notified in case of
 
 2           sickness, accident, death, emergency, or need of the
 
 3           applicant, if such notification is desired; and
 
 4      (9)  The social security number of the applicant.
 
 5      (b)  The department of attorney general, at the time of
 
 6 application, shall ask whether the applicant has an advance
 
 7 health-care directive.  The department of the attorney general
 
 8 shall issue or renew an identification certificate bearing the
 
 9 designation, "advance health-care directive," a symbol or
 
10 abbreviation thereof, for each applicant who has so indicated.
 
11 For the purposes of this subsection, "advance health-care
 
12 directive" means an individual instruction in writing, a living
 
13 will, or a durable power of attorney for health care."
 
14      SECTION 3.  New statutory material is underscored.
 
15      SECTION 4.  This Act shall take effect on January 1, 2001.
