                   A  BILL  FOR  AN  ACT

RELATING TO THE STATE INTERNET PORTAL.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Findings and purpose.  The legislature finds
 
 2 that the expansion of the Internet has fundamentally transformed
 
 3 society and the conduct of business.  In order to better serve
 
 4 citizens and businesses in the new economy, government must
 
 5 expand access to information and provide government services over
 
 6 the Internet, while ensuring Internet access points for everyone
 
 7 in order to reduce the "digital divide".
 
 8      The State has entered into a contract with a vendor to
 
 9 establish, develop, operate, maintain, and expand an Internet
 
10 portal for the purpose of increasing electronic access and
 
11 commerce among Hawaii residents, businesses, and government
 
12 entities.  At no cost to the State, the portal manager will
 
13 provide all necessary hardware, software, portal infrastructure,
 
14 administration, operation, systems analysis, programming,
 
15 delivery of services, training, marketing, collection and
 
16 distribution of payments, and a help desk.  With a portal manager
 
17 in place, additional electronic government applications should be
 
18 made available on a regular basis, with the state library system
 
19 providing primary access for citizens seeking Internet access.

 1 In addition, electronic government services should be expanded
 
 2 through partnerships with entities such as the University of
 
 3 Hawaii and the department of education.
 
 4      All statutory fees collected by the portal manager on behalf
 
 5 of a government agency will be remitted in full to the government
 
 6 agency.  All charges for value added electronic services will be
 
 7 retained by the portal manager to pay for the core and ongoing
 
 8 costs of operating the portal as well as applications development
 
 9 costs associated with the deployment of standard and premium
 
10 services.
 
11      The purpose of this Act is (1) to establish a mechanism for
 
12 oversight of the portal manager and authorize the setting of
 
13 charges for value added electronic services that will be
 
14 collected by the portal manager; and (2) assist the public
 
15 library system in providing access to the Internet portal.
 
16      SECTION 2.  Definitions.  As used in this Act, unless the
 
17 context otherwise requires:
 
18      "Committee" means the Access Hawaii Committee.
 
19      "Internet" means the global information system that is
 
20 logically linked together by a globally unique address space
 
21 based on the Internet Protocol (IP), or its subsequent
 
22 extensions; and that is able to support communications using the
 
23 Transmission Control Protocol/Internet Protocol (TCP/IP) suite,

 1 or its subsequent extensions, or other IP-compatible protocols;
 
 2 and that provides, uses, or makes accessible, either publicly or
 
 3 privately, information to users.
 
 4      "Internet portal" means the centralized electronic
 
 5 information system by which public information is provided via
 
 6 dial-in modem or continuous link to the public through
 
 7 subscription or through public libraries.
 
 8      "Government agency" means any government agency that stores,
 
 9 gathers, or generates public information, including all branches
 
10 of government, all executive departments, boards, and commissions
 
11 of the State or counties, and all public corporations created by
 
12 the legislature.
 
13      "Portal manager" means the entity or person engaged to
 
14 manage and operate the Internet portal on behalf of the State of
 
15 Hawaii.
 
16      "Value added electronic services" means services including,
 
17 but not limited to:
 
18      (1)  Providing periodic, continual, and ongoing access to
 
19           information maintained by a government agency without
 
20           requiring separate requests for information as it is
 
21           created;
 
22      (2)  Compiling data or performing other research services;
 
23      (3)  Permitting the electronic filing of reports, renewals,

 1           or applications; or
 
 2      (4)  The ability to transact business over the Internet
 
 3           portal.
 
 4      SECTION 3.  Access Hawaii committee; establishment;
 
 5 membership; chairperson.(a)  There is established within the
 
 6 office of the governor, on a special and temporary basis, the
 
 7 Access Hawaii Committee, until June 30, 2003, at which time the
 
 8 committee shall cease to exist.
 
 9      (b)  The committee shall consist of twelve or more voting ex
 
10 officio members, or designated representatives, including the
 
11 governor's special advisor for technology development, the
 
12 administrator of the information and communication services
 
13 division in the department of accounting and general services,
 
14 the administrator of the state procurement office, the director
 
15 of the office of information practices, the director of commerce
 
16 and consumer affairs, a member of the senate to be chosen by the
 
17 president of the senate, a member of the house of representatives
 
18 to be chosen by the speaker of the house, a representative of the
 
19 judiciary to be chosen by the chief justice, and the chief
 
20 information officers of the four counties.
 
21      (c)  The governor's special advisor for technology
 
22 development shall serve as the chairperson of the committee.
 
23      SECTION 4.  Duties of the committee.  (a)  The committee

 1 shall provide oversight of the portal manager including:
 
 2      (1)  Review of the annual strategic plan and periodic
 
 3           reports on potential new applications and services
 
 4           submitted by the portal manager;
 
 5      (2)  Review and approval of all charges to portal users;
 
 6      (3)  Review and approval of service level agreements
 
 7           negotiated by government agencies with the portal
 
 8           manager;
 
 9      (4)  Review of annual financial reports and audit of the
 
10           portal manager;
 
11      (5)  Review of annual customer satisfaction surveys
 
12           conducted by the portal manager; and
 
13      (6)  Review of performance measures of the portal submitted
 
14           as part of the service management plan for portal-wide
 
15           indicators and application specific indicators.
 
16      (b)  The committee shall assist the Hawaii state public
 
17 library system in providing access to the Internet portal and
 
18 advice on the following:
 
19      (1)  Being an avenue for distribution of access for the
 
20           public to the Internet for purposes of education and
 
21           information;
 
22      (2)  Installing Internet access computers, routers, and
 
23           lines; and

 1      (3)  Providing Internet training in at least half of the
 
 2           public libraries.
 
 3      SECTION 5.  Annual report.  The committee shall submit an
 
 4 annual report on the operations of the portal and assistance
 
 5 provided to the Hawaii state public library system to the
 
 6 legislature twenty days prior to the convening of each regular
 
 7 legislative session.
 
 8      SECTION 6.  There is appropriated out of the general
 
 9 revenues of the State of Hawaii the sum of $          , or so
 
10 much thereof as may be necessary for fiscal year 2000-2001, to
 
11 provide funding for the Hawaii state public library system for
 
12 Internet access computers and connections, digitalization
 
13 equipment, and Internet kiosks to provide the general public
 
14 greater access to information on the Internet.
 
15      SECTION 7.  The sum appropriated shall be expended by the
 
16 Hawaii state public library system for the purposes of this Act.
 
17      SECTION 8.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 9.  This Act shall take effect upon its approval.
