DESCRIPTION:
Requires the DOE to implement the educational accountability
system for Hawaii's public schools.  Requires DOE to develop a
collaborative process with stakeholders, including
representatives of affected bargaining units, parents,
administration, and students.  Allows student input into quality

                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATIONAL ACCOUNTABILITY.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-1004, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§302A-1004  Educational [assessment and] accountability[;]
 
 4 system; annual reports.(a)  The department shall [establish]
 
 5 implement a comprehensive system of educational accountability to
 
 6 motivate and support the improved performance of students and the
 
 7 education system.  This accountability system shall:
 
 8      (1)  Include student accountability; school or collective
 
 9           professional accountability; individual professional
 
10           accountability for teachers, principals, and other
 
11           employees; and public accounting for other significant
 
12           partners to the education process;
 
13     [(1)] (2)  Link authority and adequate resources to
 
14           responsibility;
 
15     [(2)] (3)  Define clear roles for all parties and lines of
 
16           responsibility and mutual obligation[;] and develop a
 
17           collaborative process with stakeholders, including
 
18           representatives of appropriate bargaining units,
 
19           parents, administration, and students.  Specifically,
 
20           students should provide input into the quality of their

 1           education regarding teachers and school administration;
 
 2     [(3)] (4)  Involve fair and adequate assessment against
 
 3           agreed upon goals;
 
 4     [(4)] (5)  Invoke a full and balanced set of appropriate
 
 5           [actions (assistance, rewards, or sanctions) for
 
 6           observed performance;] consequences for observed
 
 7           performance, including rewards and recognition for
 
 8           those schools that meet or exceed their goals,
 
 9           assistance to those that fall short, and sanctions for
 
10           those that given adequate assistance and ample time,
 
11           continue to fail to meet goals;
 
12     [(5)] (6)  Involve a statewide annual student assessment
 
13           program that [is explicitly aligned with the Hawaii]
 
14           provides annual data on student, school, and system
 
15           performance in core subjects at each grade level in
 
16           terms of student performance relative to statewide
 
17           content and performance standards and embodies high and
 
18           rigorous expectations for the attainment of all
 
19           students; [and]
 
20     [(6)] (7)  Involve a comprehensive school profile or report
 
21           card for each school, which shall include, but not be
 
22           limited to, student performance measures, school
 
23           attendance, drop-out rates, and parental involvement.

 1           These reports shall be made available annually to the
 
 2           board, the governor, the legislature, the parents, and
 
 3           the general public[.];
 
 4      (8)  Require that teachers and administrators engage in the
 
 5           continuous professional growth and development that
 
 6           ensure their currency with respect to disciplinary
 
 7           content, leadership skill, knowledge, or pedagogical
 
 8           skill, as appropriate to their position.  This
 
 9           requirement may be established by the department in
 
10           terms of credit hours earned or their equivalent in
 
11           professional development activity certified by the
 
12           department as appropriate in focus and rigor; and
 
13      (9)  Establish an explicit link between professional
 
14           evaluation results and individual accountability for
 
15           professional development of the knowledge, skill, and
 
16           professional behavior necessary to the position, by
 
17           requiring that results of the professional evaluation
 
18           be used by the department to prescribe appropriate
 
19           consequences.  Appropriate consequences include a full
 
20           and balanced range of actions for observed performance
 
21           such as recognition or reward, assistance, and
 
22           sanction.
 
23      Beginning with the 2001-2002 school year, the department

 1 shall submit to the legislature, the governor, and the board of
 
 2 education at least twenty days prior to the convening of each
 
 3 regular legislative session a report of the specifics of the
 
 4 design of the comprehensive accountability system, as well as the
 
 5 fiscal requirements and legislative actions necessary to create
 
 6 the accountability system.
 
 7      (b)  The department shall submit to the legislature and to
 
 8 the governor, at least twenty days prior to the convening of each
 
 9 regular legislative session, an educational status report that
 
10 includes but is not limited to the following:
 
11      (1)  Results of school-by-school assessments of educational
 
12           outcomes[, including reference to such student
 
13           performance standards and school-by-school assessment
 
14           models as may be developed by the commission on
 
15           performance standards and adopted by the board.  This
 
16           paragraph is repealed on June 30, 2001];
 
17      (2)  Summaries of [school improvement plans;] each school's
 
18           standards implementation design;
 
19      (3)  Summary descriptions of the demographic makeup of the
 
20           schools, with indications of the range of these
 
21           conditions among schools within Hawaii;
 
22      (4)  Comparisons of conditions affecting Hawaii's schools
 
23           with the conditions of schools in other states; and

 1      (5)  Other such assessments as may be deemed appropriate by
 
 2           the board.
 
 3      (c)  The department shall provide electronic access to
 
 4 computer-based financial management, student information, and
 
 5 other information systems to the legislature and the auditor.
 
 6 The department shall submit to the legislature and to the
 
 7 governor, at least twenty days prior to the convening of each
 
 8 legislative session, a school-by-school expenditure report that
 
 9 includes but is not limited to the following:
 
10      (1)  The financial analysis of expenditures by the
 
11           department with respect to the following areas:
 
12           (A)  Instruction, including face-to-face teaching, and
 
13                classroom materials;
 
14           (B)  Instructional support, including pupil, teacher,
 
15                and program support;
 
16           (C)  Operations, including non-instructional pupil
 
17                services, facilities, and business services;
 
18           (D)  Other commitments, including contingencies,
 
19                capitol improvement projects, out-of-district
 
20                obligations, and legal obligations; and
 
21           (E)  Leadership, including school management, program
 
22                and operations management, and district
 
23                management; and

 1      (2)  The measures of accuracy, efficiency, and productivity
 
 2           of the department, districts, and schools in delivering
 
 3           resources to the classroom and the student.
 
 4      (d)  The implementation of this section shall not be subject
 
 5 to negotiation under chapter 89 until June 30, 2003."
 
 6      SECTION 2.  Act 74, Session Laws of Hawaii 1999, is amended
 
 7 by amending section 3 to read as follows:
 
 8      "SECTION 3.  The department of education shall submit a
 
 9 report on [the findings and recommendations of the design of the
 
10 comprehensive accountability system referred to in section 2 of
 
11 this Act, to the legislature, and to the governor, at least
 
12 twenty days prior to the convening of the regular legislative
 
13 session of 2000.  This report shall include, but not be limited
 
14 to, the essential elements of the design, a timeline for its
 
15 implementation, the legislative actions necessary to enable
 
16 implementation, as well as a fiscal note describing resources
 
17 necessary to execute the designs.  The department of education
 
18 shall submit a report on] the status of the implementation of the
 
19 [comprehensive] educational accountability system to the
 
20 legislature, and to the governor, at least twenty days prior to
 
21 the convening of the regular legislative session of 2001."
