Requires organizations providing services to children to check on
sex offender registration information by telephone access before
engaging a person to work with the children, and requires the

                   A  BILL  FOR  AN  ACT

RELATING TO SEX OFFENDERS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 846E, Hawaii Revised Statutes, is
 
 2 amended by amending by adding a new section to be appropriately
 
 3 designated and to read as follows:
 
 4      "§846E-    Youth organizations; department of education;
 
 5 obtaining information required.  (a)  An organization providing
 
 6 services to children under the age of eighteen shall access
 
 7 information on registered sex offenders under section 846E-3(d)
 
 8 prior to engaging a person in a paid or voluntary capacity who
 
 9 will be working in close proximity to children.
 
10      (b)  The department of education shall access information on
 
11 registered sex offenders under section 846-3(d) prior to
 
12 employing a volunteer who will be working in close proximity to
 
13 children.
 
14      (c)  For purposes of this section, notwithstanding section
 
15 846E-3(d), access to information shall be furnished upon a phone
 
16 call to the Hawaii criminal justice data center; provided that no
 
17 fee shall be assessed to access the information by phone.
 
18      (d)  As used in this section, "services" includes sport
 
19 activities, recreational activities, after-school and weekend

 1 activities, community-school activities, and arts and crafts, or
 
 2 any other extracurricular activities for children."
 
 3      SECTION 2.  New statutory material is underscored.
 
 4      SECTION 3.  This Act shall take effect upon its approval.
