DESCRIPTION:
Implements the judicial salary commission's recommendation to
provide salary adjustments for appointed judiciary administrative
officers.  Provides that the chief justice may subsequently
determine the salaries of the administrative officers if based on

                   A  BILL  FOR  AN  ACT

RELATING TO SALARIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purposes of this Act are to:
 
 2      (1)  Provide salary adjustments for appointed judiciary
 
 3           administrative officers for fiscal years 1999-2000 and
 
 4           2000-2001; and
 
 5      (2)  Provide for the independence of the judiciary as a
 
 6           separate branch of government by allowing the chief
 
 7           justice to determine the salaries of the judiciary
 
 8           administrative officers based upon merit and other
 
 9           relevant factors.
 
10      SECTION 2.  Section 601-3, Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "§601-3 Administrative director.  (a) The chief justice,
 
13 with the approval of the supreme court, shall appoint an
 
14 administrative director of the courts to assist the chief justice
 
15 in directing the administration of the judiciary.  The
 
16 administrative director shall be a resident of the State for a
 
17 continuous period of three years prior to the administrative
 
18 director's appointment, and shall be appointed without regard to
 
19 chapters 76 and 77 and shall serve at the pleasure of the chief
 
20 justice.  The administrative director shall hold no other office

 1 or employment.  [Effective January 1, 1989, the administrative
 
 2 director shall receive a salary of $81,629 a year.  Effective
 
 3 January 1, 1990, the administrative director shall receive a
 
 4 salary of $85,302 a year.] Effective July 1, 1999, the
 
 5 administrative director shall receive a salary of $94,685 a year.
 
 6 Effective July 1, 2000, the administrative director shall receive
 
 7 a salary of $105,100 a year.  Effective July 1, 2001, the
 
 8 administrative director shall receive a salary to be determined
 
 9 by the chief justice based upon merit and other relevant factors.
 
10      (b)  The administrative director shall, subject to the
 
11 direction of the chief justice, perform the following functions:
 
12      (1)  Examine the administrative methods of the courts and
 
13           make recommendations to the chief justice for their
 
14           improvement;
 
15      (2)  Examine the state of the dockets of the courts, secure
 
16           information as to their needs of assistance, if any,
 
17           prepare statistical data and reports of the business of
 
18           the courts and advise the chief justice to the end that
 
19           proper action may be taken;
 
20      (3)  Examine the estimates of the courts for appropriations
 
21           and present to the chief justice the administrative
 
22           director's recommendations concerning them;

 1      (4)  Examine the statistical systems of the courts and make
 
 2           recommendations to the chief justice for a uniform
 
 3           system of judicial statistics;
 
 4      (5)  Collect, analyze, and report to the chief justice
 
 5           statistical and other data concerning the business of
 
 6           the courts;
 
 7      (6)  Assist the chief justice in the preparation of the
 
 8           budget, the six-year program and financial plan, the
 
 9           variance report and any other reports requested by the
 
10           legislature;
 
11      (7)  Carry out all duties and responsibilities that are
 
12           specified in Title 7 as it pertains to employees of the
 
13           judiciary; and
 
14      (8)  Attend to such other matters as may be assigned by the
 
15           chief justice.
 
16      (c)  The administrative director shall, with the approval of
 
17 the chief justice, appoint a deputy administrative director of
 
18 the courts without regard to chapters 76 and 77 and such
 
19 assistants as may be necessary.  Such assistants shall be
 
20 appointed without regard to chapters 76 and 77.  [Effective
 
21 January 1, 1989, the salary of the deputy administrative director
 
22 shall be $74,608 a year.  Effective January 1, 1990, the salary
 
23 of the deputy administrative director shall be $77,966 a year.]

 1 Effective July 1, 1999, the salary of the deputy administrative
 
 2 director shall be $86,542 a year.  Effective July 1, 2000, the
 
 3 salary of the deputy administrative director shall be $96,062 a
 
 4 year.  Effective July 1, 2001, the salary of the deputy
 
 5 administrative director shall determined by the chief justice
 
 6 based upon merit and other relevant factors.  The administrative
 
 7 director shall be provided with necessary office facilities.
 
 8      (d)  The judges, clerks, officers, and employees of the
 
 9 courts shall comply with all requests of the administrative
 
10 director for information and statistical data relating to the
 
11 business of the courts and expenditure of public funds for their
 
12 maintenance and operation.
 
13      (e)  The salary levels of the administrative director and
 
14 deputy administrative director, and the factors used to determine
 
15 such salaries, shall be disclosed in the judiciary's annual
 
16 budget submission to the legislature."
 
17      SECTION 3.  There is appropriated out of the general
 
18 revenues of the State of Hawaii the sum of $17,959, or so much
 
19 thereof as may be necessary for fiscal year 2000-2001, for salary
 
20 adjustments for appointed judiciary administrative officers for
 
21 fiscal year 1999-2000.

 1      SECTION 4.  There is appropriated out of the general
 
 2 revenues of the State of Hawaii the sum of $37,894, or so much
 
 3 thereof as may be necessary for fiscal year 2000-2001, for salary
 
 4 adjustments for appointed judiciary administrative officers for
 
 5 fiscal year 2000-2001.
 
 6      SECTION 5.  The sums appropriated shall be expended by the
 
 7 judiciary for the purposes of this Act.
 
 8      SECTION 6.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 7.  This Act shall take effect on July 1, 2000;
 
11 provided that section 2 shall take effect retroactive to July 1,
 
12 1999.
