                   A  BILL  FOR  AN  ACT

RELATING TO SALARIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to provide salary
 
 2 adjustments for appointed judiciary administrative officers for
 
 3 fiscal years 1999-2000 and 2000-2001.
 
 4      SECTION 2.  Section 601-3, Hawaii Revised Statutes, is
 
 5 amended to read as follows:
 
 6      "§601-3 Administrative director.  The chief justice, with
 
 7 the approval of the supreme court, shall appoint an
 
 8 administrative director of the courts to assist the chief justice
 
 9 in directing the administration of the judiciary.  The
 
10 administrative director shall be a resident of the State for a
 
11 continuous period of three years prior to the administrative
 
12 director's appointment, and shall be appointed without regard to
 
13 chapters 76 and 77 and shall serve at the pleasure of the chief
 
14 justice.  The administrative director shall hold no other office
 
15 or employment.  [Effective January 1, 1989, the administrative
 
16 director shall receive a salary of $81,629 a year.  Effective
 
17 January 1, 1990, the administrative director shall receive a
 
18 salary of $85,302 a year.] Effective July 1, 1999, the
 
19 administrative director shall receive a salary of $94,685 a year.

 1 Effective July 1, 2000, the administrative director shall receive
 
 2 a salary of $105,100 a year.  The administrative director shall,
 
 3 subject to the direction of the chief justice, perform the
 
 4 following functions:
 
 5      (1)  Examine the administrative methods of the courts and
 
 6           make recommendations to the chief justice for their
 
 7           improvement;
 
 8      (2)  Examine the state of the dockets of the courts, secure
 
 9           information as to their needs of assistance, if any,
 
10           prepare statistical data and reports of the business of
 
11           the courts and advise the chief justice to the end that
 
12           proper action may be taken;
 
13      (3)  Examine the estimates of the courts for appropriations
 
14           and present to the chief justice the administrative
 
15           director's recommendations concerning them;
 
16      (4)  Examine the statistical systems of the courts and make
 
17           recommendations to the chief justice for a uniform
 
18           system of judicial statistics;
 
19      (5)  Collect, analyze, and report to the chief justice
 
20           statistical and other data concerning the business of
 
21           the courts;
 
22      (6)  Assist the chief justice in the preparation of the

 1           budget, the six-year program and financial plan, the
 
 2           variance report and any other reports requested by the
 
 3           legislature;
 
 4      (7)  Carry out all duties and responsibilities that are
 
 5           specified in Title 7 as it pertains to employees of the
 
 6           judiciary; and
 
 7      (8)  Attend to such other matters as may be assigned by the
 
 8           chief justice.
 
 9      The administrative director shall, with the approval of the
 
10 chief justice, appoint a deputy administrative director of the
 
11 courts without regard to chapters 76 and 77 and such assistants
 
12 as may be necessary.  Such assistants shall be appointed without
 
13 regard to chapters 76 and 77.  [Effective January 1, 1989, the
 
14 salary of the deputy administrative director shall be $74,608 a
 
15 year.  Effective January 1, 1990, the salary of the deputy
 
16 administrative director shall be $77,966 a year.] Effective
 
17 July 1, 1999, the salary of the deputy administrative director
 
18 shall be $86,542 a year.  Effective July 1, 2000, the salary of
 
19 the deputy administrative director shall be $96,062 a year.  The
 
20 administrative director shall be provided with necessary office
 
21 facilities.
 
22      The judges, clerks, officers, and employees of the courts

 1 shall comply with all requests of the administrative director for
 
 2 information and statistical data relating to the business of the
 
 3 courts and expenditure of public funds for their maintenance and
 
 4 operation."
 
 5      SECTION 3.  There is appropriated out of the general
 
 6 revenues of the State of Hawaii the sum of $17,959, or so much
 
 7 thereof as may be necessary for fiscal year 2000-2001, for salary
 
 8 adjustments for appointed judiciary administrative officers for
 
 9 fiscal year 1999-2000.
 
10      SECTION 4.  There is appropriated out of the general
 
11 revenues of the State of Hawaii the sum of $37,894, or so much
 
12 thereof as may be necessary for fiscal year 2000-2001, for salary
 
13 adjustments for appointed judiciary administrative officers for
 
14 fiscal year 2000-2001.
 
15      SECTION 5.  The sums appropriated shall be expended by the
 
16 judiciary for the purposes of this Act.
 
17      SECTION 6.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 7.  This Act shall take effect on July 1, 2000;
 
20 provided that section 2 shall take effect retroactive to July 1,
 
21 1999.
