                   A  BILL  FOR  AN  ACT

RELATING TO METROPOLITAN PLANNING ORGANIZATIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to authorize the
 
 2 creation of a Maui metropolitan planning organization.
 
 3      SECTION 2.  Section 279E-2, Hawaii Revised Statutes, is
 
 4 amended to read as follows:
 
 5      "§279E-2 Establishment of Metropolitan Planning
 
 6 Organization.  There is established in each county with a
 
 7 population in excess of [200,000] 50,000 a metropolitan planning
 
 8 organization called the Metropolitan Planning Organization,
 
 9 abbreviated by the letters MPO.  The MPO shall be an advisory
 
10 body responsible for carrying out a continuing, comprehensive,
 
11 transportation planning process in cooperation with the State and
 
12 the appropriate county in order to advise appropriate state,
 
13 county, and federal agencies regarding that process.
 
14      The MPO shall develop through continuing cooperative input
 
15 from state and county planning agencies, the transportation plans
 
16 and planning processes or policies enumerated herein and shall
 
17 submit those plans and planning processes together with any other
 
18 advice on transportation planning as may be required to the state
 
19 legislature, the state department of transportation, the state

 1 department of business, economic development, and tourism, the
 
 2 office of planning, the legislative body of the appropriate
 
 3 county, the transportation and planning agencies of the
 
 4 appropriate county, and appropriate federal agencies.
 
 5      The MPO shall further assist and advise the state
 
 6 legislature, the state department of transportation, the state
 
 7 department of business, economic development, and tourism, the
 
 8 office of planning, the legislative body of the appropriate
 
 9 county and the transportation and planning agencies of the
 
10 appropriate county in carrying out comprehensive metropolitan
 
11 transportation planning embracing airports, bikeways, harbors,
 
12 highways, transit and waterways within the appropriate county.
 
13 The MPO shall assist and advise such appropriate agencies in
 
14 evaluating studies and programs related to transportation
 
15 planning.  The MPO shall recognize that all of its activities
 
16 shall be primarily advisory, and that the policymaking powers
 
17 shall remain with the legislature or the legislative body of the
 
18 appropriate county, whichever the case may be.  The MPO is to
 
19 develop and recommend policies, priorities, and techniques
 
20 relating to transportation planning, and shall be directly
 
21 accountable to the legislature and the legislative body of the
 
22 county as an advisory body.
 
23      For administrative purposes only, each MPO shall be assigned

 1 in part to the department of transportation of the State of
 
 2 Hawaii and in part to the county.
 
 3      Nothing in this law is intended to change the basic
 
 4 jurisdiction for planning responsibilities already given to the
 
 5 state and county agencies in existing statutes and ordinances.
 
 6 Those state and county agencies are to cooperate with the MPO by
 
 7 providing input from their present planning processes and the MPO
 
 8 will advise those agencies by way of submitting to them the
 
 9 coordinated plan which it develops."
 
10      SECTION 3.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
