                   A  BILL  FOR  AN  ACT
RELATING TO THE UNIVERSITY OF HAWAII.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 304-16.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§304-16.5  University of Hawaii tuition and fees special
 
 4 fund; tuition schedule and waivers.(a)  There is established
 
 5 the University of Hawaii tuition and fees special fund into which
 
 6 shall be deposited all revenue collected by the university for
 
 7 regular, summer, and continuing education credit tuition, tuition
 
 8 related course and fee charges, and any other charges to
 
 9 students, except as provided by law.  Moneys deposited into the
 
10 fund shall be expended to maintain or improve the university's
 
11 programs and operations and shall not be:
 
12      (1)  Used as a justification for reducing any budget request
 
13           or allotment to the University of Hawaii unless the
 
14           university requests such a reduction;
 
15      (2)  Transferred unless otherwise authorized by the
 
16           legislature; and
 
17      (3)  Restricted by the governor or the director of finance
 
18           without the prior approval of the legislature.
 
19      Any rule, policy, or action of any agency or individual in
 
20 contravention of this subsection shall be void as against public

 1 policy.
 
 2      (b)  The board of regents, or its designated
 
 3 representatives, is authorized to grant, modify, or suspend
 
 4 tuition waivers.  The board of regents shall provide a report and
 
 5 make recommendations as appropriate to the legislature on all
 
 6 tuition waivers no later than twenty days prior to the convening
 
 7 of each regular session.  This report shall include but not be
 
 8 limited to the number of tuition waivers and scholarships,
 
 9 stipends, and mandatory fees granted to financially needy
 
10 students from ethnic groups that are under-represented in the
 
11 student population of the University of Hawaii through the Hawaii
 
12 opportunity in education endowment special fund.
 
13      (c)  Any law to the contrary notwithstanding, the board of
 
14 regents may authorize expenditures from this fund for the purpose
 
15 of generating private donations for deposit into the University
 
16 of Hawaii Foundation for the purposes of the university.  Any
 
17 expenditure authorized pursuant to this subsection shall be for a
 
18 public purpose and shall not be subject to chapters 42F, 103,
 
19 103D, and 103F.  The university shall submit a comprehensive
 
20 report to the legislature every regular session detailing the use
 
21 of any funds authorized by the board under this subsection. 
 
22      (d)  Any law to the contrary notwithstanding, all of the
 
23 employer contributions for retirement benefits under chapter 88,

 1 and health and insurance benefits under chapter 87, for any
 
 2 employee entitled to these benefits whose base salaries are
 
 3 funded from the University of Hawaii tuition and fees special
 
 4 fund, shall be funded by the state general fund in the same
 
 5 manner that these employee benefits are funded for employees
 
 6 whose base salaries are funded by the state general fund."
 
 7      SECTION 2.  New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect on July 1, 2000.
