Criminal Offenses


DESCRIPTION:
Changes from misdemeanor to petty misdemeanor and not more than
$1,000 fine or imprisonment of not more than 30 days, or both,
for violations of rules pertaining to airport security, safety
measures, and persons engaged in commercial activities at public
airports.  Changes penalties for drag racing from 6 months to 30

                   A  BILL  FOR  AN  ACT

RELATING TO CRIMINAL OFFENSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 261-21, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§261-21  Penalties.(a)  Any person violating this
 
 4 chapter, or any of the rules or orders issued pursuant thereto
 
 5 and relating to: 
 
 6      (1)  Safety  measures, practices, or requirements;
 
 7      (2)  Airport security measures or requirements; or
 
 8      (3)  The licensing and regulation of persons engaged in
 
 9           commercial activities at public airports,
 
10 duly adopted or served, shall be guilty of a petty misdemeanor[.]
 
11 and shall be fined not more than $1,000 or imprisoned not more
 
12 than thirty days, or both.
 
13      (b)  Except as provided in subsection (c), any person
 
14 violating any rule relating to motor vehicles and traffic control
 
15 or the operation of any equipment or motor vehicle in or on the
 
16 operational area of the airport shall be guilty of [an offense] a
 
17 violation as defined under the Penal Code and be fined not more
 
18 than $500.
 
19      (c)  Any person violating any rule relating to parking of

 1 motor vehicles or equipment at a public airport shall have
 
 2 committed a traffic infraction as set forth in chapter 291D, the
 
 3 adjudication of which shall be subject to the provisions
 
 4 contained therein."
 
 5      SECTION 2.  Section 291C-103, Hawaii Revised Statutes, is
 
 6 amended by amending subsection (e) to read as follows:
 
 7      "(e)  Any person who violates this section, except
 
 8 subsection (d), shall be fined not more than $500 or imprisoned
 
 9 not more than [six months,] thirty days, or both.  Any person who
 
10 violates subsection (d) shall be fined not more than $500 or be
 
11 sentenced to perform community service, or both."
 
12      SECTION 3.  Statutory material to be repealed is bracketed.
 
13 New statutory material is underscored.
 
14      SECTION 4.  This Act shall take effect upon its approval.
