                   A  BILL  FOR  AN  ACT

RELATING TO HEALTH.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 132D, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "§132D-      Health care facilities; report of fireworks
 
 5 incidents.  Each health care facility in this State shall report
 
 6 all incidents of injuries and fatalities caused by fireworks to
 
 7 the department of health and the police department of the county
 
 8 in which a person was attended or treated.  All reports shall be
 
 9 in writing or in the manner specified by the department of
 
10 health, and may include information on the type of fireworks and
 
11 the nature of the injuries as an optional item.
 
12      As used in this section, "health care facility" includes any
 
13 program, institution, place, building, or agency, or portion
 
14 thereof, private or public, whether organized for profit or not,
 
15 used, operated, or designed to provide medical diagnosis,
 
16 treatment, nursing, rehabilitative, or preventive care to any
 
17 person or persons.  The term includes but is not limited to
 
18 health care facilities that are commonly referred to as
 
19 hospitals, extended care and rehabilitation centers, nursing

 1 homes, skilled nursing facilities, intermediate care facilities,
 
 2 hospices for the terminally ill that require licensure or
 
 3 certification by the department of health, kidney disease
 
 4 treatment centers including freestanding hemodialysis units,
 
 5 outpatient clinics, organized ambulatory health care facilities,
 
 6 emergency care facilities and centers, home health agencies,
 
 7 health maintenance organizations, and others providing similarly
 
 8 organized services regardless of nomenclature."
 
 9      SECTION 2.  New statutory material is underscored.
 
10      SECTION 3.  This Act shall take effect upon its approval.
