                     A BILL FOR AN ACT

RELATING TO VOTING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 11, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§11-       Eligibility to vote; election day registration.
 
 5 (a)  A person who meets the following requirements at the time of
 
 6 an election shall be eligible to vote.  The person shall:
 
 7      (1)  Be eighteen years of age or older;
 
 8      (2)  Be a citizen of the United States; and
 
 9      (3)  Maintain residence in Hawaii for twenty days
 
10           immediately preceding the election.
 
11      (b)  A person who is eligible to vote may register to vote
 
12 and vote on the day of any election by appearing in person at the
 
13 polling place for the precinct in which the person maintains
 
14 residence by completing a registration form as prescribed by the
 
15 chief election officer, being examined under oath as to the
 
16 person's qualifications as a voter, and providing proof of
 
17 residence.
 
18      A person may prove residence for purposes of registering by:
 
19      (1)  Showing a valid Hawaii driver's license identification
 
20           card or state identification card;

 1      (2)  Showing any document approved by the chief election
 
 2           officer as proper identification;
 
 3      (3)  Showing one of the following:
 
 4           (A)  A current valid student identification card from a
 
 5                post-secondary educational institution in Hawaii,
 
 6                if a list of students from that institution has
 
 7                been prepared and certified to the county clerk;
 
 8                or
 
 9           (B)  A current student fee statement that contains the
 
10                student's valid address in the precinct together
 
11                with a picture identification card;
 
12           or
 
13      (4)  Having a voter who is registered to vote in the
 
14           precinct sign an affidavit in the presence of the
 
15           precinct official, or other designee of the chief
 
16           election officer, vouching that the voter personally
 
17           knows that the person is a resident of the precinct.  A
 
18           voter who has been vouched for on election day may not
 
19           sign a proof of residence affidavit vouching for any
 
20           other individual on that election day.
 
21      (c)  The precinct official, or other designee of the chief
 
22 election officer, who registers a person at the polling place on
 
23 election day shall not handle that voter's ballots at any time
 
24 prior to the opening of the ballot box after the voting ends.

 1      (d)  Registration forms for affidavits shall be available at
 
 2 each polling place.
 
 3      (e)  If a person who registers on election day proves
 
 4 residence by affidavit of a registered voter, the form containing
 
 5 the affidavit shall be attached to the person's registration card
 
 6 until the person's address is verified by the county clerk.
 
 7 Registration forms completed on election day shall be forwarded
 
 8 to the county clerk who shall add the name of each voter to the
 
 9 registration system unless the information forwarded is
 
10 substantially deficient.  A county clerk who finds an election
 
11 day registration substantially deficient shall give written
 
12 notice to the person whose registration is found deficient.  In
 
13 situations where a person proves residency by third party
 
14 affidavit, an election day registration shall not be found
 
15 deficient solely because the person who provided proof of
 
16 residence was ineligible to do so, unless it is determined that
 
17 either party committed voter fraud or attempted to commit voter
 
18 fraud.  Any suspected voter fraud shall be promptly reported to
 
19 both the chief election officer and the attorney general for
 
20 investigation.
 
21      (f)  The precinct official, or other designee of the chief
 
22 election officer, responsible for election day registration shall
 
23 keep a record of the number of individuals who attempt to

 1 register on election day but who cannot provide proof of
 
 2 residence as required by this section.  The record shall be
 
 3 forwarded to the chief election officer with the election returns
 
 4 for that precinct.
 
 5      (g)  The county clerk shall provide each precinct with an
 
 6 accurate precinct map or precinct finder to assist the precinct
 
 7 official, or other designee of the chief election officer, in
 
 8 determining whether an address is located in that precinct."
 
 9      SECTION 2.  New statutory material is underscored.
 
10      SECTION 3.  This Act shall take effect upon its approval.
