                   A  BILL  FOR  AN  ACT

RELATING TO STATE OWNED PUBLIC HOUSING. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The State is responsible for managing public
 
 2 housing.  The new federal housing law requires that tenants be
 
 3 represented on a public housing agency board.  It is good public
 
 4 policy to organize tenants and provide them with the ability to
 
 5 develop self-sufficiency.
 
 6      The purpose of this Act is to establish a statewide tenant
 
 7 advisory board and from this board select a chairperson to
 
 8 represent the tenants' interests on the board of the housing and
 
 9 community development corporation of Hawaii.
 
10      SECTION 2.  Chapter 201G, Hawaii Revised Statutes, is
 
11 amended by adding a new section to be appropriately designated
 
12 and to read as follows:
 
13      "§201G-    State resident advisory board.  (a)  There is
 
14 created a board designated as the state resident advisory board.
 
15 The state resident advisory board shall be comprised of members
 
16 representing tenants of federal, state, and federal section 8
 
17 public housing projects who shall be elected at the state public
 
18 housing forum under subsection (d) in accordance with the
 
19 following:

 1      (1)  Four members representing federal housing projects,
 
 2           with at least one to represent collectively the
 
 3           counties of Maui, Kauai, and Hawaii;
 
 4      (2)  Four members representing state public housing
 
 5           projects, with at least one to represent collectively
 
 6           the counties of Maui, Kauai, and Hawaii;
 
 7      (3)  Four members representing federal section 8 housing
 
 8           projects, with at least one to represent collectively
 
 9           the counties of Maui, Kauai, and Hawaii; and
 
10      (4)  Three members representing senior housing projects.
 
11      (b)  Each member of the state resident advisory board shall
 
12 serve for a two-year term, except as provided in paragraphs (1)
 
13 to (4), and shall serve no more than two full consecutive terms;
 
14 provided that the terms of the members of the first board shall
 
15 be staggered as follows:
 
16      (1)  Two of the four federal housing representatives
 
17           receiving the greatest number of votes shall serve a
 
18           three-year term;
 
19      (2)  Two of the four state housing representatives receiving
 
20           the greatest number of votes shall serve a three-year
 
21           term;
 
22      (3)  Two of the four federal section 8 housing
 
23           representatives receiving the greatest number of votes

 1           shall serve a three-year term; and
 
 2      (4)  The senior housing representatives receiving the
 
 3           greatest number of votes shall serve a three-year term.
 
 4      (c)  Elections of state resident advisory board members
 
 5 shall be conducted and certified by the League of Women Voters at
 
 6 the state public housing forum with funding by the housing and
 
 7 community development corporation.
 
 8      (d)  The executive director annually shall convene a state
 
 9 public housing forum consisting of tenant representatives of each
 
10 housing project who shall elect the members of the state resident
 
11 advisory board in accordance with subsection (a).
 
12      (e)  The state resident advisory board shall select four
 
13 representatives from among its membership who shall represent the
 
14 state resident advisory board's interest on the board of the
 
15 housing and community development corporation.  The
 
16 representatives shall represent each type of housing project
 
17 specified in subsection (a).
 
18      (f)  Attendance at a state resident advisory board meeting,
 
19 greater than fifty per cent of the members to which entitled,
 
20 shall constitute a quorum, whose affirmative vote shall be
 
21 necessary for all actions by the state resident advisory board.
 
22 The state resident advisory board members shall receive no
 
23 compensation for services, but shall be entitled to necessary

 1 expenses, including travel expenses, incurred in the performance
 
 2 of their duties which shall be satisfied out of the state low
 
 3 income housing revolving fund established under section 201G-45.
 
 4      (g)  The corporation shall assist in convening the state
 
 5 public housing forum, the state tenant advisory board, and shall
 
 6 ensure that the provisions of this section are executed in a
 
 7 timely manner."
 
 8      SECTION 3.  Section 201G-3, Hawaii Revised Statutes, is
 
 9 amended as follows:
 
10      1.  By amending subsection (a) to read as follows:
 
11      "(a)  There is created a board consisting of [nine] thirteen
 
12 members, of whom six shall be public members appointed by the
 
13 governor as provided in section 26-34.  Public members shall be
 
14 appointed from each of the counties of Honolulu, Hawaii, Maui,
 
15 and Kauai. One public member shall be the chairperson of the
 
16 rental housing trust fund advisory commission.  The public
 
17 members of the board shall serve four-year staggered terms;
 
18 provided that the initial appointments shall be as follows:  two
 
19 members to be appointed for four years; two members to be
 
20 appointed for three years; and one member to be appointed for two
 
21 years.  The chairperson of the rental housing trust fund advisory
 
22 commission shall serve a concurrent term on the board.  The
 
23 director of business, economic development, and tourism and the

 1 director of human services, or their designated representatives,
 
 2 [and] a representative of the governor's office, and the four
 
 3 representatives of the state resident advisory board established
 
 4 in section 201G-  , shall be ex officio voting members.  The
 
 5 corporation shall be headed by the board."
 
 6      2.  By amending subsection (c) to read as follows:  
 
 7   "(c)  [Five] Seven members shall constitute a quorum, whose
 
 8 affirmative vote shall be necessary for all actions by the
 
 9 corporation.  The members shall receive no compensation for
 
10 services, but shall be entitled to necessary expenses, including
 
11 travel expenses, incurred in the performance of their duties."
 
12      SECTION 4.  Statutory material to be repealed is bracketed.
 
13 New statutory material is underscored.
 
14      SECTION 5.  This Act shall take effect upon its approval.
