                   A  BILL  FOR  AN  ACT

RELATING TO THE UNIVERSITY OF HAWAII FACILITIES USE REVOLVING
   FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 304-8.957, Hawaii Revised Statutes, is
 
 2 amended by amending the title and subsection (a) to read as
 
 3 follows:
 
 4      "[[]§304-8.957[]]  University of Hawaii real property and
 
 5 facilities use revolving fund.(a)  There is established the
 
 6 University of Hawaii real property and facilities use revolving
 
 7 fund, into which shall be deposited all revenues collected by the
 
 8 university for the use of university real property and
 
 9 facilities, except as otherwise provided by law.  The board of
 
10 regents may establish prices, fees and charges, including those
 
11 for the sale, lease, or use of university real property and
 
12 facilities, which include land, buildings, grounds, furnishings,
 
13 and equipment.  The board of regents shall be exempt from the
 
14 public notice and public hearing requirements of chapter 91 in
 
15 establishing and amending the fees and charges.  The university
 
16 may establish separate accounts within the revolving fund for
 
17 major program activities.  Funds deposited into the revolving
 
18 fund accounts shall be expended to pay the costs of operating
 
19 university facilities, including maintenance, administrative

 1 expenses, salaries, wages, and benefits of employees; contractor
 
 2 services, supplies, security, furnishings, equipment, janitorial
 
 3 services, insurance, utilities, and other operational expenses.
 
 4 Revenues not expended as provided in this section may be
 
 5 transferred to other university funds to be invested or expended
 
 6 for the general benefit of the university.  All expenditures from
 
 7 this fund shall be subject to appropriation."
 
 8      SECTION 2.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 3.  This Act shall take effect upon its approval.
