                   A  BILL  FOR  AN  ACT

RELATING TO WORKERS' COMPENSATION. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 386-98, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (d) to read as follows:
 
 3      "(d)  An offense under subsections (a) and (b) shall
 
 4 constitute a:
 
 5      (1)  Class C felony, but a class B felony for a health care
 
 6           provider, if the value of the moneys obtained or denied
 
 7           is not less than $2,000;
 
 8      (2)  Misdemeanor, but a class C felony for a health care
 
 9           provider, if the value of the moneys obtained or denied
 
10           is less than $2,000; or 
 
11      (3)  Petty misdemeanor if the providing of false information
 
12           did not cause any monetary loss.
 
13      Any person subject to a criminal penalty under this section
 
14 shall be ordered by a court to make restitution to an insurer or
 
15 any other person for any financial loss sustained by the insurer
 
16 or other person caused by the fraudulent act."
