Tobacco Settlement


DESCRIPTION:
Allocates 20 per cent of tobacco settlement moneys to emergency
and budget reserve fund and 55 per cent to Department of Health;
requires DOH to spend 10 per cent on early childhood education
and care and youth programs and 10 per cent on substance abuse

                   A  BILL  FOR  AN  ACT

RELATING TO HAWAII TOBACCO SETTLEMENT MONEYS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 328L-2, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  The fund shall be used for the purpose of receiving
 
 4 and appropriating the tobacco settlement moneys as follows:
 
 5      (1)  [Forty] Twenty per cent shall be appropriated into the
 
 6           emergency and budget reserve fund under section 328L-3;
 
 7      (2)  [Thirty-five] Fifty-five per cent shall be appropriated
 
 8           to the department for purpose of section 328L-4; and
 
 9      (3)  Twenty-five per cent shall be appropriated into the
 
10           Hawaii tobacco prevention and control trust fund under
 
11           section 328L-5."
 
12      SECTION 2.  Section 328L-3, Hawaii Revised Statutes, is
 
13 amended by amending subsection (a) to read as follows:
 
14      "(a)  There is established in the state treasury the
 
15 emergency budget and reserve fund which shall be a special fund
 
16 administered by the director of finance, into which shall be
 
17 deposited:
 
18      (1)  [Forty] Twenty per cent of the moneys received from the
 
19           tobacco settlement moneys under section 328L-(b)(1);

 1      (2)  Appropriations made by the legislature to the fund."
 
 2      SECTION 3.  Section 328L-4, Hawaii Revised Statutes, is
 
 3 amended to read as follows:
 
 4      "[[]§328L-4[]]  Use of funds appropriated to the department.
 
 5 The department, immediately upon receipt of the [thirty-five]
 
 6 fifty-five per cent of moneys appropriated pursuant to section
 
 7 328L-2(b)(2) shall:
 
 8      (1)  Transfer up to ten per cent of the total moneys
 
 9           received by the State from tobacco settlement moneys to
 
10           the department of human services for the children's
 
11           health insurance program; [and]
 
12      (2)  Expend up to ten per cent of the total moneys received
 
13           by the State from tobacco settlement moneys to support
 
14           early childhood education and care, and youth programs;
 
15           provided that a portion of the ten per cent may be
 
16           transferred to the department of human services for
 
17           this purpose;
 
18      (3)  Expend ten per cent of the total moneys received by the
 
19           State from tobacco settlement moneys to support
 
20           substance abuse treatment services for pregnant women,
 
21           families, and teenagers; provided that a portion of the
 
22           ten per cent may be transferred to the department of
 
23           human services for this purpose; and

 1     [(2)] (4)  Expend the remainder of the moneys received by the
 
 2           department for health promotion and disease prevention
 
 3           programs, including but not limited to, maternal child
 
 4           health and child development programs, promotion of
 
 5           healthy lifestyles (including fitness, nutrition, and
 
 6           tobacco control), and prevention oriented public health
 
 7           programs.
 
 8      For purposes of paragraph [(2),] (4), the director shall
 
 9 convene an advisory group that shall be separate from the tobacco
 
10 prevention and control advisory board, to strategically plan the
 
11 development and implementation of preventive systems to achieve
 
12 measurable outcomes and to make recommendations for the
 
13 expenditure of these moneys.  The advisory group shall be
 
14 composed of nine members with expertise in the programs under
 
15 paragraph [(2),] (4), and shall be selected at the discretion of
 
16 the director."
 
17      SECTION 4.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 5.  This Act shall take effect upon its approval.
