                   A  BILL  FOR  AN  ACT

RELATING TO THE ELECTION OF THE OFFICE OF HAWAIIAN AFFAIRS' BOARD
   OF TRUSTEES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 13D-4, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§13D-4[]]  Election of board members.  Members of the
 
 4 board of trustees shall be [elected at a special election held in
 
 5 conjunction with the general election] nominated at a primary
 
 6 election and elected at the general election in every even-
 
 7 numbered year.  Except as otherwise provided by this chapter,
 
 8 members shall be nominated and elected in the manner prescribed
 
 9 by this title.
 
10      Nomination papers.  The chief election officer shall prepare
 
11 the nomination papers in such a manner that a candidate desiring
 
12 to file for election to the board shall be able to specify
 
13 whether the candidate is seeking a seat requiring residency on a
 
14 particular island or a seat without such residency requirement.
 
15      Ballot.  The board of trustees ballot shall be prepared in
 
16 such a manner that every voter qualified and registered under
 
17 section 13D-3 shall be afforded the opportunity to vote for [each
 
18 and every] one candidate seeking election to the board[.] to

 1 represent the island on which the voter resides, and for up to
 
 2 four candidates who are seeking election in the at-large
 
 3 category.  The ballot shall contain the names of all board
 
 4 candidates arranged alphabetically; provided that the names of
 
 5 candidates seeking seats requiring residency on a particular
 
 6 island shall also be grouped by island of residency.  Each
 
 7 eligible voter shall be entitled to receive the board of trustees
 
 8 ballot and to vote for the number of seats [available.] allowed
 
 9 under this section."
 
10      SECTION 2.  Section 13D-5, Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "§13D-5 Term of office; vacancies.  The term of office of
 
13 members of the board shall be four years beginning on the day of
 
14 the [special election held in conjunction with the] general
 
15 election of the year in which they are elected and ending on the
 
16 day of the [special election held in conjunction with the] second
 
17 general election after their election; except that the term of
 
18 office of board members elected in 1980 shall be as follows:  the
 
19 four board members elected with the highest number of votes shall
 
20 serve four years; the remaining members elected shall serve two
 
21 years.  Members of the board may be re-elected without
 
22 restriction as to the number of terms.
 
23      Any vacancy that may occur through any cause other than the

 1 expiration of the term of office shall be filled in accordance
 
 2 with section 17-7."
 
 3      SECTION 3.  Statutory material to be repealed is bracketed.
 
 4 New statutory material is underscored.
 
 5      SECTION 4.  This Act shall take effect upon its approval.
