                   A  BILL  FOR  AN  ACT

RELATING TO STUDENTS WITH DISABILITIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 103-72, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§103-72  Transcription of instructional materials.
 
 4 Contracts for the procurement of instructional materials shall
 
 5 include a provision whereby the publisher or manufacturer of the
 
 6 instructional materials shall provide to the State [has], at no
 
 7 additional cost and in a timely manner, the right to transcribe
 
 8 [and], reproduce, and distribute the material in braille, large
 
 9 print, recordings, or other accessible media for the use of
 
10 physically-disabled students, including the visually handicapped,
 
11 unable to use the material in conventional print and form.  Such
 
12 right shall include computer diskette versions, computer files,
 
13 or other electronic format versions of the printed or nonprinted
 
14 materials if made available to any other state or upon receipt of
 
15 a written request from the department of education or University
 
16 of Hawaii and the right to make those corrections, revisions, and
 
17 other modifications as may be necessary.  The electronic format
 
18 shall be mutually agreed upon by the publisher or manufacturer
 
19 and the department of education or university.

 1      For purposes of this section, "student" means any
 
 2 physically-disabled student who attends or is registered to
 
 3 attend any academic or noncollege type school established and
 
 4 maintained by the department of education or the University of
 
 5 Hawaii."
 
 6      SECTION 2.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect upon its approval.
