DESCRIPTION:
Requires minors to inform ear and body piercers of their minority
status and provide parental consent for any ear or body piercing.
Requires ear and body piercers to notify all prospective clients
of need for parental consent if client is a minor and to obtain

                   A  BILL  FOR  AN  ACT

RELATING TO BODY PIERCING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 577, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§577-     Parental consent for minors to have ear or body
 
 5 piercing.  (a)  In order to have ears or any other part of a
 
 6 minor's body pierced, the minor must first:
 
 7      (1)  Inform the person who performs ear or body piercing of
 
 8           the minor's status as a minor; and
 
 9      (2)  Provide written consent from the minor's parent or
 
10           guardian to the person who performs ear or body
 
11           piercing.
 
12      (b)  No person who performs ear or body piercing may do so
 
13 to a minor without first:
 
14      (1)  Informing all prospective clients that parental consent
 
15           is required for any minor who requests ear or body
 
16           piercing;
 
17      (2)  Ascertaining, by reasonable request for identification,
 
18           the prospective client's status as a minor or adult;
 
19           and

 1      (3)  If the prospective client is a minor, obtaining in
 
 2           writing the consent of the minor's parent or guardian.
 
 3      (c)  For the purposes of this section, a "person who
 
 4 performs ear or body piercing" means a person who performs these
 
 5 activities as:
 
 6      (1)  Part of the person's job or occupation for
 
 7           remuneration; or
 
 8      (2)  If not remunerated, as an ancillary activity that is
 
 9           part of a paid purchase of ear or body jewelry meant
 
10           for the client's personal cosmetic adornment."
 
11      SECTION 2.  New statutory material is underscored.
 
12      SECTION 3.  This Act shall take effect upon its approval.
