                   A  BILL  FOR  AN  ACT

RELATING TO SEX OFFENDERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that one in three repeat
 
 2 sex offenders will re-offend despite treatment.  Recidivism
 
 3 usually occurs three and one-half years after release from
 
 4 prison, primarily because, once parole is completed, monitoring
 
 5 of the sex offender is insufficient.  According to a National
 
 6 Institute of Justice research report release in June 1997 on
 
 7 child sexual molestation, "[i]ntensive community-based
 
 8 supervision and management of child molesters are essential to
 
 9 reduce sexual victimization rates; child abusers have been known
 
10 to re-offend as late as twenty years following release into the
 
11 community."
 
12      The legislature recognizes that many repeat sex offenders
 
13 can be viable, contributing members of the community.  However,
 
14 similar to a person with a life-long disease that requires
 
15 medical supervision to the end of life, a repeat sex offender who
 
16 has a high-risk repeat disorder needs continual supervision until
 
17 the end of life.  With continual supervision and guidance, many
 
18 repeat sex offenders will not return to the criminal justice
 
19 system, thus providing greater protection to the public and
 
20 saving taxpayer's dollars for prison space.

 1      The purpose of this Act is to require a mandatory lifetime
 
 2 parole term for second time felony sex offenders.
 
 3      SECTION 2.  Chapter 706, Hawaii Revised Statutes, is amended
 
 4 by adding a new section to be appropriately designated and to
 
 5 read as follows:
 
 6      "§706-    Repeat sex offender; lifetime parole.
 
 7 Notwithstanding sections 706-669, 706-670, or any other provision
 
 8 of law to the contrary, the Hawaii paroling authority shall
 
 9 impose a mandatory lifetime parole term upon any person who is
 
10 convicted under sections 707-730, 707-731, 707-732, or 707-733.5,
 
11 after having previously been convicted of an offense under
 
12 sections 707-730, 707-731, 707-732, or 707-733.5, or of an
 
13 offense under federal law or under the laws of another state that
 
14 is comparable to an offense under sections 707-730, 707-731, 707-
 
15 732, or 707-733.5.  Under no circumstances shall the Hawaii
 
16 paroling authority finally and unconditionally release such
 
17 person."
 
18      SECTION 3.  This Act shall apply to any person convicted of
 
19 any offense under section 707-730, 707-731, 707-732, or 707-733.5
