                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1                       Part 1.  Introduction
 
 2      SECTION 1.  This Act shall be known, and may be cited as, as
 
 3 the Student Bill of 2000.
 
 4      SECTION 2.  The legislature finds that the Hawaii state
 
 5 student council serves as a student organization that focuses its
 
 6 energy on enhancing the school environment.  The council acts as
 
 7 a bridge between students and the department of education, the
 
 8 board of education, and the legislature.  The guidelines for
 
 9 student representation and participation, adopted by the board of
 
10 education on July 20, 1972, state that the functions of the
 
11 council are to:
 
12      (1)  Schedule regular meetings for the discussion of student
 
13           issues and concerns;
 
14      (2)  Recommend and advise courses of action to the
 
15           department of education;
 
16      (3)  Maintain communication with the board of education; and
 
17      (4)  Communicate all deliberations and activities to all
 
18           district and school student councils.
 
19      The legislature also finds that chapter 317, Hawaii Revised

 1 Statutes, provides for the establishment of an annual conference
 
 2 of secondary school students (grades seven to twelve), to enable
 
 3 students in Hawaii's secondary schools to identify, discuss, and
 
 4 arrive at recommended solutions to major youth problems, with
 
 5 emphasis on school problems that require the attention and joint
 
 6 action by the students, the department of education, and the
 
 7 legislature.
 
 8      The recommendations of the Hawaii state student council and
 
 9 Hawaii state student conference form the basis for the
 
10 initiatives contained in Parts 2 to 8 of this Act.
 
11                    Part 2.  Teacher Evaluation
 
12      SECTION 3.  There is appropriated out of the general
 
13 revenues of the State of Hawaii the sum of $        , or so much
 
14 thereof as may be necessary for fiscal year 2000-2001, for the
 
15 development and implementation of a teacher evaluation program
 
16 that allows school administrators, parents, teachers, and
 
17 students to assess teacher effectiveness in promoting student
 
18 success and school improvement, and assures the public that only
 
19 effective teachers continue in the classroom; provided that the
 
20 department of education shall:
 
21      (1)  Work with the Hawaii State Teachers Association, the
 
22           Hawaii state student council, and the Hawaii State
 
23           Parents, Teachers, and Students Association in the

 1           development and implementation of the teacher
 
 2           evaluation program; and
 
 3      (2)  Work with the Hawaii State Teachers Association to
 
 4           develop an action plan that provides a smooth
 
 5           transition from PATH (program for assessing teaching in
 
 6           Hawaii)--the existing teacher evaluation program--to
 
 7           the new evaluation program.
 
 8                    Part 3.  School Facilities
 
 9      SECTION 4.  There is appropriated out of the general
 
10 revenues of the State of Hawaii the sum of $        , or so much
 
11 thereof as may be necessary for fiscal year 2000-2001, to enable
 
12 school custodians in the department of education, with respect to
 
13 student lavatories, to:
 
14      (1)  Daily:
 
15           (A)  Clean toilets, urinals, basins, shelves, and
 
16                hardware with cleaner-disinfectant solution;
 
17           (B)  Spot clean mirrors, partitions, walls, and
 
18                stainless steel and chrome surfaces;
 
19           (C)  Sweep and mop floors using cleaner-disinfectant
 
20                solution;
 
21           (D)  Remove standing water from floors;
 
22           (E)  Empty waste receptacles; and
 
23           (F)  Resupply toilet paper, towels, napkins, and soap

 1                as needed;
 
 2      (2)  At least once a week:
 
 3           (A)  Remove stains and buildup from toilets, basins,
 
 4                urinals, fixtures, and floors;
 
 5           (B)  Scrub or foam down floors and walls using
 
 6                disinfectant solution;
 
 7           (C)  Spot clean glass in doors and partitions, walls,
 
 8                doors and ledges, etc., as needed;
 
 9           (D)  Spray and buff accessible areas of resilient
 
10                floors to remove scuffs and marks;
 
11           (E)  Clean light fixtures;
 
12           (F)  Strip, clean, and apply wax to resilient floors;
 
13           (G)  Replace burned out lights as needed;
 
14           (H)  Spot clean floors as needed because of accidents;
 
15           (I)  Clean and polish furniture;
 
16           (J)  Dust window ledges, sills, furniture, bookcases,
 
17                etc.; and
 
18      (3)  Clean windows at least once a year.
 
19                      Part 4.  Safety Office
 
20      SECTION 5.  Chapter 302A, Hawaii Revised Statutes, is
 
21 amended by adding a new section to be appropriately designated
 
22 and to read as follows:
 
23      "§302A-     Departmental safety office.  There is

 1 established within the office of the superintendent a safety
 
 2 office, which shall develop and ensure compliance with all
 
 3 requirements and standards relating to workplace, employee, and
 
 4 student safety and health; hazardous materials management; campus
 
 5 security; fire safety; and the coordination of safety and health
 
 6 training programs."
 
 7      SECTION 6.  There is appropriated out of the general
 
 8 revenues of the State of Hawaii the sum of $        , or so much
 
 9 thereof as may be necessary for fiscal year 2000-2001, to provide
 
10 five additional permanent, full-time equivalent (5.00 FTE),
 
11 professional staff positions; and one additional permanent, full-
 
12 time equivalent (1.00 FTE), clerical staff position, including
 
13 other current expenses and equipment, to carry out the purposes
 
14 of section 5.
 
15                Part 5.  School Security Attendants
 
16      SECTION 7.  Chapter 302A, Hawaii Revised Statutes, is
 
17 amended by adding a new section to be appropriately designated
 
18 and to read as follows:
 
19      "§302A-     Training of school security attendants.  Subject
 
20 to the availability of funding, the initial and ongoing training
 
21 of school security attendants shall be carried out by the
 
22 department of public safety after June 30, 2001; provided that
 
23 the department of education shall remain responsible for the

 1 management and supervision of school security attendants."
 
 2      SECTION 8.  Section 26-14.6, Hawaii Revised Statutes, is
 
 3 amended by adding a new subsection to read as follows:
 
 4      "§26-14.6  Department of public safety.(a)  The department
 
 5 of public safety shall be headed by a single executive to be
 
 6 known as the director of public safety.
 
 7      (b)  The department of public safety shall be responsible
 
 8 for the formulation and implementation of state policies and
 
 9 objectives for correctional, security, law enforcement, and
 
10 public safety programs and functions, for the administration and
 
11 maintenance of all public or private correctional facilities and
 
12 services, for the service of process, and for the security of
 
13 state buildings.
 
14      (c)  Effective July 1, 1990, the Hawaii paroling authority
 
15 and the crime victim compensation commission are placed within
 
16 the department of public safety for administrative purposes only.
 
17      (d)  Effective July 1, 1990, the functions and authority
 
18 heretofore exercised by:
 
19      (1)  The department of corrections relating to adult
 
20           corrections and the intake service centers;
 
21      (2)  The judiciary relating to the sheriff's office and
 
22           judiciary security personnel; and
 
23      (3)  The department of the attorney general relating to

 1           state law enforcement officers and narcotics
 
 2           enforcement investigators with the narcotics
 
 3           enforcement division,
 
 4 shall be transferred to the department of public safety.
 
 5      (e)  Effective July 1, 1990, the functions and authority
 
 6 heretofore exercised by the department of health pursuant to
 
 7 chapters 329 and 329C, with the exception of sections 329-2,
 
 8 329-3, and 329-4(3) to (8), shall be transferred to the
 
 9 department of public safety.
 
10      (f)  Effective July 1, 1990, the functions, authority, and
 
11 obligations, together with the limitations imposed thereon and
 
12 the privileges and immunities conferred thereby, exercised by a
 
13 "sheriff", "sheriffs", a "sheriff's deputy", "sheriff's
 
14 deputies", a "deputy sheriff", "deputy sheriffs", or a "deputy",
 
15 under sections 21-8, 47-18, 88-51, 105-4, 134-11, 134-51,
 
16 183D-11, 187A-14, 201G-55, 201G-74, 231-25, 281-108, 281-111,
 
17 286-52, 286-52.5, 321-1, 322-6, 325-9, 325-80, 353-11, 383-71,
 
18 438-5, 445-37, 482E-4, 485-6, 501-42, 501-171, 501-218, 521-78,
 
19 578-4, 584-6, 587-33, 603-29, 604-6.2, 606-14, 607-2, 607-4,
 
20 607-8, 633-8, 634-11, 634-12, 634-21, 634-22, 651-33, 651-37,
 
21 651-51, 654-2, 655-2, 657-13, 660-16, 666-11, 666-21, 803-23,
 
22 803-34, 803-35, 804-14, 804-18, 804-41, 805-1, 806-71, and 832-23
 
23 shall be exercised to the same extent by the department of public

 1 safety.
 
 2      (g)  Effective January 1, 1993, the functions and authority
 
 3 heretofore exercised by the attorney general and the department
 
 4 of the attorney general relating to the executive security
 
 5 officers shall be transferred to the department of public safety.
 
 6      (h)  Effective July 1, 1999, the functions and authority
 
 7 heretofore exercised by the director of public safety and the
 
 8 department of public safety relating to after hours security
 
 9 contracts at department of education facilities, except for the
 
10 security functions being performed by employees of the public
 
11 library system as well as the contractual security services for
 
12 the libraries, shall be transferred to the department of
 
13 education.
 
14      (i)  Effective January 1, 1993, the functions and authority
 
15 heretofore exercised by the director of health and the department
 
16 of health relating to uniformed security employees and security
 
17 contracts at various state hospitals throughout the State shall
 
18 be transferred to the department of public safety.
 
19      (j)  Effective January 1, 1993, the functions and authority
 
20 heretofore exercised by the director of human services and the
 
21 department of human services relating to contractual security
 
22 guard services shall be transferred to the department of public
 
23 safety.

 1      (k)  Effective July 1, 1994, the functions and authority
 
 2 heretofore exercised by the adjutant general relating to security
 
 3 for national guard and state civil defense facilities in the
 
 4 Diamond Head complex, for after work hours, shall be transferred
 
 5 to the department of public safety.
 
 6      (l)  Effective July 1, 2001, the functions and authority
 
 7 heretofore exercised by the superintendent of education and the
 
 8 department of education relating to the initial and ongoing
 
 9 training of school security attendants shall be transferred to
 
10 the department of public safety; provided that:
 
11      (1)  The training of school security attendants by the
 
12           department of public safety shall be subject to the
 
13           availability of funding; and
 
14      (2)  The department of education shall remain responsible
 
15           for the management and supervision of school security
 
16           attendants."
 
17      SECTION 9.  There is appropriated out of the general
 
18 revenues of the State of Hawaii the sum of $        , or so much
 
19 thereof as may be necessary for fiscal year 2000-2001, to provide
 
20 one permanent, full-time equivalent (1.00 FTE), school security
 
21 attendant position in each middle, intermediate, and high school
 
22 for every four hundred students, with a minimum of one permanent,
 
23 full-time equivalent (1.00 FTE), attendant positions per school.

 1      SECTION 10.  There is appropriated out of the general
 
 2 revenues of the State of Hawaii the sum of $        , or so much
 
 3 thereof as may be necessary for fiscal year 2000-2001, to provide
 
 4 initial and ongoing training for school security attendants
 
 5 throughout the State.  The sum appropriated by this section shall
 
 6 be expended by the department of public safety.
 
 7                    Part 6.  Athletic Equipment
 
 8      SECTION 11.  There is appropriated out of the general
 
 9 revenues of the State of Hawaii the sum of $        , or so much
 
10 thereof as may be necessary for fiscal year 2000-2001, to
 
11 replace, repair, or upgrade worn, unsafe, obsolete, or unsanitary
 
12 athletic equipment.
 
13                        Part 7.  Computers
 
14      SECTION 12.  There is appropriated out of the general
 
15 revenues of the State of Hawaii the sum of $        , or so much
 
16 thereof as may be necessary for fiscal year 2000-2001, to
 
17 purchase additional computer hardware and software for the
 
18 classroom to meet the department of education's standard of one
 
19 computer for every six students.
 
20      SECTION 13.  There is appropriated out of the general
 
21 revenues of the State of Hawaii the sum of $        , or so much
 
22 thereof as may be necessary for fiscal year 2000-2001, to provide
 
23 each middle, intermediate, and high school with:

 1      (1)  The personnel resources needed to operate a computer
 
 2           laboratory that is open before and after school; and
 
 3      (2)  The program resources needed to upgrade and update
 
 4           hardware and software for the computer laboratory
 
 5           described in paragraph (1).
 
 6                  Part 8.  Co-curricular Concerns
 
 7      SECTION 14.  There is appropriated out of the general
 
 8 revenues of the State of Hawaii the sum of $        , or so much
 
 9 thereof as may be necessary for fiscal year 2000-2001, to provide
 
10 one permanent, full-time equivalent (1.00 FTE), student
 
11 activities coordinator position at each high school.
 
12                    Part 9.  General Provisions
 
13      SECTION 15.  Unless otherwise provided, the sums
 
14 appropriated shall be expended by the department of education for
 
15 the purposes of this Act.
 
16      SECTION 16.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 17.  This Act shall take effect on July 1, 2000.
