REPORT TITLE:
Assistive Technology


DESCRIPTION:
Authorizes DOE to sell an assistive technology device to a
student with a disability, upon request and at a depreciated
price, as the student leaves the school system.  Requires
procuring agencies to get training regarding procurement of such
devices from the assistive technology project designated for
Hawaii under the federal Assistive Technology Act of 1998.
Requires DOE to account for every assistive technology device

                   A  BILL  FOR  AN  ACT

RELATING TO PROCUREMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Assistive technology devices foster human
 
 2 dignity by enabling individuals with disabilities to live
 
 3 independently, make choices, pursue meaningful careers, receive
 
 4 free and appropriate education, and be fully included and
 
 5 integrated into the mainstream of society.  Assistive technology
 
 6 devices assist two hundred twenty-three thousand persons with
 
 7 disabilities in Hawaii, and that population is growing.
 
 8      The legislature finds that a problem with respect to the
 
 9 State's supply of assistive technology devices is that the
 
10 devices may not be reused or recycled because the devices are
 
11 individualized to the person who uses them.
 
12      The purpose of this Act is to allow the department of
 
13 education to sell assistive technology devices to students with
 
14 disabilities at a depreciated price once the student leaves the
 
15 public school system.
 
16      SECTION 2.  Chapter 103D, Hawaii Revised Statutes, is
 
17 amended by adding a new section to part XII to be appropriately
 
18 designated and to read as follows:

 1      "§103D-     Sale of assistive technology devices.  (a)  The
 
 2 department of education, upon the request of the student with a
 
 3 disability, may sell an assistive technology device to the
 
 4 student with a disability to whom it was assigned as the student
 
 5 leaves the public school system.  To determine the sale price of
 
 6 the device, the remaining useful depreciable life of the device
 
 7 shall be divided by the useful depreciable life of the device
 
 8 when purchased.  The quotient shall be multiplied by the price of
 
 9 the device when new.  The product obtained shall be the sales
 
10 price.  The depreciable life shall be determined under section
 
11 167 of the Internal Revenue Code of 1986, as amended.  The
 
12 proceeds of the sales shall be paid into the general fund as a
 
13 state realization.
 
14      (b)  Agencies that procure assistive technology devices and
 
15 services shall receive basic orientation and training to obtain
 
16 knowledge regarding the procurement of those devices and services
 
17 from the assistive technology project designated for the State
 
18 under the federal Assistive Technology Act of 1998."
 
19      SECTION 3.  (a)  The department of education shall account
 
20 for, from the period beginning July 1, 1995, and ending June 30,
 
21 2000, every assistive technology device purchased by the
 
22 department of education.  An itemized list of every assistive
 
23 technology device purchased shall be reported to the legislature,
 
24 and shall include for each device the following:

 1      (1)  Date of purchase;
 
 2      (2)  Quantity;
 
 3      (3)  Cost per item;
 
 4      (4)  Source of funding: if the device was purchased with
 
 5           state, federal, or private funds;
 
 6      (5)  Whether the device is currently being used by the
 
 7           department of education;
 
 8      (6)  If the device is currently being used, identifying the
 
 9           school where the device is being used; and
 
10      (7)  If the device is not being used:
 
11           (A)  Identifying the storage location; or
 
12           (B)  Indicating the date of disposal.
 
13      The report shall also indicate the numbers of assistive
 
14 technology devices unaccounted for.
 
15      (b)  The department of education shall submit a report of
 
16 its findings to the legislature no later than twenty days prior
 
17 to the convening of the regular session of 2001.
 
18      SECTION 4.  New statutory material is underscored.
 
19      SECTION 5.  This Act shall take effect upon its approval.
