                   A  BILL  FOR  AN  ACT

RELATING TO SMALL BOAT HARBORS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§200-     Designated moorage for commercial fishing.  (a)
 
 5 The department shall designate moorage not to exceed ninety feet
 
 6 to be used solely by commercial fishing vessels in each small
 
 7 boat harbor, except as provided in section 200-9(b).  Any
 
 8 commercial fishing vessel which uses such moorage shall hold a
 
 9 valid use permit and pay such fees as provided in section 200-10.
 
10      (b)  The department may adopt rules pursuant to chapter 91
 
11 to implement this section."
 
12      SECTION 2.  New statutory material is underscored.
 
13      SECTION 3.  This Act shall take effect upon its approval.
