                   A  BILL  FOR  AN  ACT

RELATING TO PUBLIC LANDS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Notwithstanding any provision of chapter 76, 77,
 
 2 89, 103D, or 171, Hawaii Revised Statutes, or any county
 
 3 ordinance to the contrary, the State may enter into negotiations
 
 4 to lease public lands and enter into a development agreement with
 
 5 a private developer or developers to develop and operate a prison
 
 6 facility.  The appropriate state agency to carry out this Act
 
 7 shall be determined by the governor.
 
 8      The development agreement shall specify that no public funds
 
 9 shall be expended to develop, construct, or operate the prison
 
10 facility while under the control of the developer or developers,
 
11 its successors, or any private entity contracted to operate the
 
12 prison facility.
 
13      The State shall have two years commencing from the effective
 
14 date of this Act to enter into a development agreement authorized
 
15 pursuant to this Act.
 
16      SECTION 2.  This Act shall take effect upon its approval and
 
17 shall be repealed on July 1, 2002.
