                   A  BILL  FOR  AN  ACT

RELATING TO FREE SPEECH.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to propose an
 
 2 amendment to Article I, section 4, of the Constitution of the
 
 3 State of Hawaii to expand the constitutional guarantee of free
 
 4 speech to quasi-public facilities.
 
 5      SECTION 2.  Article I, section 4, of the Constitution of the
 
 6 State of Hawaii is amended to read as follows:
 
 7               "FREEDOM OF RELIGION, SPEECH, PRESS,
 
 8                       ASSEMBLY AND PETITION
 
 9      Section 4.  No law shall be enacted respecting an
 
10 establishment of religion, or prohibiting the free exercise
 
11 thereof, or abridging the freedom of speech or of the press or
 
12 the right of the people peaceably to assemble and to petition the
 
13 government for a redress of grievances. Every person may freely
 
14 speak, write or publish the person's sentiments on all subjects
 
15 in any forum, but shall be responsible for the abuse of these
 
16 rights."
 
17      SECTION 3.  The question to be printed on the ballot shall
 
18 be as follows:
 
19      "May every person freely speak, write or publish the
 
20      person's sentiments on all subjects in any forum, but shall
 
21      be responsible for the abuse of these rights?"

 1      SECTION 4.  New constitutional material is underscored.
 
 2      SECTION 5.  This amendment shall take effect upon compliance
 
 3 with article XVII, section 3, of the Constitution of the State of
 
 4 Hawaii.
