                   A  BILL  FOR  AN  ACT

RELATING TO THE REMOVAL OF NUISANCE SEAWEED.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1 SECTION 1. The legislature finds that inmate labor has been

 2 used on the island of Maui since 1848 for such purposes as

 3 destroying and combating the spread of the gorse plant pest;

 4 completing the Maui belt road; connecting the Kahakuloa and

 5 Honokahao Roads; providing labor for reforestation and watershed

 6 protection projects; and constructing and maintaining flumes,

 7 water lines, reservoirs, roads, and trails in the Waiakamoi water

 8 reservation. In addition to building roads urgently required for

 9 the growth of Maui and not within the financial capabilities of

10 the county government, these public service projects helped to

11 train and return to the community many heavy equipment operators.

12 The legislature also finds that there is an urgent need to

13 remove nuisance seaweed from the shoreline and nearshore waters

14 of Maui. Because of the continuous and labor-intensive nature of

15 this work, cost is understandably a major concern and possibly

16 contributes to the unwillingness of state and local governments

17 to work together to address this critical problem. Consequently,

18 the purpose of this Act is to allow the director of public

19 safety, with the approval of the governor, to enter into an

 1 agreement with the mayor of the county of Maui to use inmate

 2 labor from the Maui community correctional center to remove

 3 nuisance seaweed from the shoreline and nearshore waters of the

 4 island.

 5 SECTION 2. The director of public safety, with the approval

 6 of the governor, may enter into an agreement with the mayor of a

 7 county to use inmate labor from a community correctional center

 8 to remove nuisance seaweed from the shoreline and nearshore

 9 waters of the State, subject to the following conditions:

10 (1) The mayor of the county shall agree to pay:

11 (A) The cost of the inmates' labor, at the prevailing

12                rate paid to other inmates;

13 (B) The cost of guarding and supervising inmates, at

14 the rate paid to other guards and supervisors; and

15 (C) The cost of feeding and transporting the guards

16                and inmates;

17 (2) The director of public safety, with the assistance of

18 the chairperson of the board of land and natural

19 resources, shall train the inmates in the use of

20           appropriate equipment, including tools and machinery;

21 (3) The chairperson of the board of land and natural
